HomeMy WebLinkAboutRES NO 142-96 RESOLUTION NO. 1 4 2 ' 9 6 A RESOLUTION ADOPTING THE 1996 2015 REGIONAL TRANSPORTATION CAPITAL IMPROVEMENT PLAN. WHEREAS, Ordinance No. 3513 added Chapter 15.84 to the Bakersfield Municipal Code, implementing a Transportation Impact Fee Program for new development in order for new development to bear a proportionate share of the cost of the new or expanded transportation facilities required by such development; and WHEREAS, Ordinance No. eliminating the need for local development consistent with the General Plan; and 3736 amended said chapter, traffic mitigation study for Metropolitan Bakersfield 2010 WHEREAS, Council annually adopt a improvement plan for road program; and Ordinance No. 3736 requires that the City proposed fee schedule and capital construction funded by the impact fee WHEREAS, an initial study was conducted in accordance with Section 15153, State California Environmental Guidelines and it was determined the use of the Environmental Impact Report prepared for the Bakersfield 2010 General Plan is adequate for this existing Transportation Impact Fee program; and Quality Act prior Final Metropolitan change to the WHEREAS, a public hearing before the City Council was advertised and held December 4, 1996. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The fee schedule set forth in Exhibit "A" and the capital improvement plan set forth in Exhibit "B" is hereby approved and adopted. 3. The effective date of this resolution shall be 60 days after adoption or on the effective date of the County's Transportation Impact Fee Ordinance adopting the fee schedule, whichever is later. 4. The final Environmental Impact Report for the Metropolitan Bakersfield 2010 General Plan is hereby certified and findings as set forth in Exhibit "A" attached hereto and incorporated as though set forth fully herein are hereby adopted. ..... 000 .....
