A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CALLING A SPECIAL MUNICIPAL
ELECTION FOR THE PURPOSE OF FILLING A VACANCY
ON THE COUNCIL FOR THE UNEXPIRED TERM IN WARD
6, REQUESTING THE BOARD OF SUPERVISORS OF THE
COUNTY OF KERN TO ORDER CONSOLIDATION OF SAID
ELECTION WITHANY OTHER ELECTION HELD WITH THE
COUNTY OF KERN ON TUESDAY, JUNE 6, 1995, AND
SETTING THE DATE FOR THE NEWLY ELECTED
COUNCILMEMBER OF WARD 6 TO ASSUME OFFICE.
];HEREAS, the City Charter, Section 16 and 74 provides for
said Special Election; and
WHEREAS, Section 16 of the City Charter requires a
Special Election be held whenever a vacancy occurs on the Council
more than six months prior to the date of the next general election
for Councilmember in the ward where the vacancy occurs; and
WHEREAS, the Council seat for Ward 6 became vacant on
December 7, 1994, more than six months prior to the next general
election for Ward 6 councilmember; and
WHEREAS, Section 67 of the Charter of the City of
Bakersfield prescribes that a General Municipal Election for
election of members of the Council shall be held on the first
Tuesday after the first Monday in November in each even-numbered
year; and
WHEREAS, it is the desire of this Council that the
election above specified be consolidated with any other election
held with the County of Kern to be held Tuesday, June 6, 1995; and
WHEREAS, the City Clerk will certify the results of the
election within twenty-eight days following June 6, 1995.
NOW, THEREFORE BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That the Special Municipal Election is hereby called
to be held in the City of Bakersfield on Tuesday, the 6th day of
June, 1995, for the purpose of filling the vacancy on the City
Council for Ward 6 for the remainder of the unexpired term.
2. That the Board of Supervisors of the County of Kern
is hereby requested to make an order, pursuant to Sections 23302 et
seq. of the Elections Code of the State of California,
consolidating the Special Municipal Election for the purpose of
filling a vacancy on the Council for the unexpired term in Ward 6
and any election held within the same jurisdiction in the County of
Kern.
3. That the Board of Supervisors of the County of Kern
is hereby authorized to canvass, or cause to be canvassed, the
returns of said Special Municipal Election for filling of vacancy
in Ward 6 and are requested to provide a "Statement of Election
Results" to the City Clerk.
4. That the City Clerk is hereby directed to transmit
and file certified copies of this resolution with the Board of
Supervisors of Kern County and the County Clerk of Kern County, as
required by Section 23302 of the Elections Code of the State of
California.
5. That upon certification of the election by the City
Clerk, the newly elected Councilmember will take office on or after
July 3, 1995.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
