A RESOLUTION MAKING FINDINGS, RECOMMENDING
APPROVAL OF KERN COUNTY INITIATED
AMENDMENT TO THE KERN RIVER PLAN ELEMENT
OF THE METROPOLITAN BAKERSFIELD 2010
GENERAL PLAN AND TRANSMITTING
RECOMMENDATION TO KERN COUNTY BOARD OF
SUPERVISORS.
WHEREAS, Pursuant to Section 1.3 B. of the Kern River Plan Element,
notice was received from Kern County proposing an amendment to the Kern River Plan
Element of the Metropolitan Bakersfield 2010 General Plan; and
WHEREAS, proposed amendment to the Kern River Plan Element of
Metropolitan Bakersfield 2010 General Plan is as follows:
AMENDMENT:
Kern County is proposing to amend the Kern River Plan
Element consisting of a change from 5.2 (Residential,
Maximum 16 Unit Per Net Acre) to 6.2 (General
Commercial) on approximately four acres located along the
east side of North Chester Avenue between Roberts Lane
and the Kern River;
and
and
WHEREAS, the subject site has a historical record of commercial land use;
WHEREAS, the subject site was inadvertently designated 5.2; and
WHEREAS, Kern County is the Lead Agency and will comply with the
requirements of the California Environmental Quality Act; and
WHEREAS, Section 1.3 B. of the Kern River Plan Element specifies that
"If application is made for amendment of the plan within an area of County Jurisdiction,
the notice of the proposed amendment shall promptly first be given to the City Council
who shall promptly conduct a public hearing and make a recommendation on the
proposal to the Board of Supervisors"; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, and pursuant to Section 1.3 B of
the Kern River Plan Element conducted and held a public hearing on WEDNESDAY,
January 11, 1995, on the above described proposed amendment to the Kern River
Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of
the hearing having been given at least ten (10) calendar days before the hearing by
publication in the Bakersfield Californian, a local newspaper of general circula~t~,~
findings:
WHEREAS, the Council has considered and hereby makes the following
1. All required public notices have been given.
2. Kern County is the applicant and the Lead Agency and as the Lead
Agency will be responsible for complying with the California Environmental Quality Act.
3. The site has a history of commercial uses.
4. The site is better suited for commercial rather than residential land uses.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:

Board Of Supenfsors of the proposed amendment consisting of a change from 5.2 to 6.2
to the Kern River Element of the Metropolitan Bakersfield 2010 General Plan,
constituting changes as shown on the map marked Exhibit "A," attached hereto and
incorporated as though fully set forth, for property generally located along the east side
of North Chester Avenue between Roberts Land and the Kern River.
