HomeMy WebLinkAboutRES NO 28-95RESOLUTION NO. 28-95 A RESOLUTION ORDERING THE VACATION OF THE 33 FOOT WIDE ALLEY IN BLOCK 350 (BETWEEN 14TH STREET AND THE A.T. & S.F. RAILWAY, FROM "M" STREET TO "N" STREET) IN THE CITY OF BAKERSFIELD. WHEREAS, on Wednesday, January 11, 1995, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, 9assed and adopted its Resolution of Intention No. 1134 declaring its intention to order the vacation of the 33 foot wide alley in Block 350 (Between 14th Street and the A.T. & S.F. Railway, from "M" Street to "N" Street) in the City of Bakersfield; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, February 8, 1995, after notices were duly publi~hed and posted as required by law. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The 33 foot wide alley in Block 350 (between 14th Street and the A.T. & S.R. Railway, from "M" Street to "N" Street) in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: All of the 33 foot wide alley extending through Block 350 as shown on "Map of the City of Bakersfield, Kern County, California", filed November 25, 1898 in Map Book 1, Pages 13 and 14 in the Kern County Recorder is unnecessary for present or prospective alley purposes and is hereby vacated, subject to the conditions enumerated herein. 3. A nonexclusive easement and right of way shall be reserved for public utilities and municipal services facilities to lay, construct, operate, maintain, repair, reconstruct, change the size of or remove pipelines, conduits, cable, wires, poles or any other structures, fixtures or equipment, in, under, across, over and upon the entire area in above described alley. 4. An access easement shall be reserved for use by the property owners in said Block 350 for ingress and egress purposes over, on and across the above described alley area. 5. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. ...... o0o ......
