RESOLUTION NO.
A RESOLUTION FINDING AND DECLARING
THAT THE INTERESTS OF THE RESIDENTS
RESIDING ALONG PINEWOOD LAKE DRIVE
WILL BEST BE SERVED BY APPLICATION
OF THE PROVISIONS OF THE CALIFORNIA
VEHICLE CODE TO THAT STREET.

WHEREAS, Pinewood Lake Drive is a privately-owned and
maintained road within the City not generally held open for use
of the public for purposes of vehicular travel; and
WHEREAS, by reason of its connection with highways, the
interests of the residents residing along Pinewood Lake Drive and
the motoring public will best be served by application of the
provisions of the California Vehicle Code to that road; and
WHEREAS, Pinewood Lake is a common interest development
as defined by Civil Code § 1351; and
WHEREAS, all members of the Board of Directors of the
Pinewood Lake Homeowners Association signed a petition requesting
that the City of Bakersfield enact a resolution applying the
provisions of the Vehicle Code to Pinewood Lake Drive; and
WHEREAS, a public hearing was duly noticed and held on
March 22, 1995, with ten days prior written notice to all
homeowners within Pinewood Lake development; and
WHEREAS, prior to any enforcement of the provisions of
the Vehicle Code on Pinewood Lake Drive pursuant to this
resolution, the Pinewood Lake Homeowners Association shall erect
appropriate traffic signs at the entrance to the road of the
size, shape, and color as to be readily legible during daylight
hours from a distance of 100 feet, to the effect that the road is
subject to the provisions of the California Vehicle Code; and
WHEREAS, the Pinewood Lake Homeowners Association shall
also be responsible for erecting any and all traffic signs,
markings and devices necessary for the enforcement of provisions
of the Vehicle Code. Such signs, markings and devices shall
conform to the uniform standards and specifications adopted by
the Department of Transportation.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The foregoing facts and findings are true and
correct, and are incorporated herein.
2. The provisions of the California Vehicle Code
shall apply to Pinewood Lake Drive at such time as the following
conditions are met:
A. Appropriate signs shall be erected by the
Pinewood Lake Homeowners Association at the entrance to the road
of the size, shape and color as to be readily legible during
daylight hours from a distance of one hundred feet, to the effect
that the road is subject to the provisions of the California
Vehicle Code.
B. The Pinewood Lake Homeowners Association
shall also be responsible for erecting any and all traffic signs,
markings and devices which conform to the uniform standards and
specifications adopted by the Department of Transportation, as
required by the Police Chief.
