MINUTES SPECIAL MEETING OF NOVEMBER 22, 1993 SPECIAL MEETING - 3:00 P.M. - Council Chambers, City Hall 1501 Truxtun Avenue, Bakersfield 1. ROLL CALL ACTION TAKEN Present: Absent: Agency Members Araujo (seated at 3:10), Cohrs (seated at 3:15), Gaskill, Lindsay, Morea, Prince Agency Member Sceales UNFINISHED BUSINESS Public hearing for review and discussion of the Disposition and Development Agreement with John Q. Hammons for the Bakersfield Convention Center Hotel Project. Gaskill opened the hearing and explained that the public hearing would be contin- ued to the Special Meeting of December 15, 1993, 3:00 p.m., in the Council Chambers of City Hall. The following individuals spoke in support of the project: Graham Kaye-Eddie, Consultant; Mike Olague read and submitted correspondence from Jerry Stanners, President, Greater Bakersfield Chamber of Commerce; Leroy Weygand, President, Kern County Tax Payers Assn.; Gerald B. Clifford, business owner and real estate broker; Terry Arnold, business owner; and Bruce Keith, Architect. Dean A. Gay, Realtor, expressed his apprehension of this project and how it will effect the future of Bakersfield and questioned Attachment 8 of the agreement regarding leaseback. Dave Jones, President, John Q. Hammons Company, explained their intentions and thanked the public for their support. Marvin Dean explained his prior ques- tions were only concerns, that at no time did he not support the hotel, and requested entering into a volunteer MOU, which was submitted in writing. UNRNISHED BUSINESS continued ACTION TAKEN Roy Saunders, asked questions of Executive Director Tandy: 1) Under what section of the UBC is it proposed that the building be completed - what year? 2) Is the long-term bond issue also going to be guaranteed, as with the developer personally guaranteeing the construction loan? 3) Are there going to be any school fees attached to this project? 4) Are there going to be any Transportation Impact Fees attached to this project? Executive Director Tandy clarified why a continuation of the hearing is being presented: It appears that the bonds may not be marketed until after the first of January. There are some changes that have been made in the State redevelopment laws which, if the transaction is closed after January 1st, necessitates the posting of an additional document for two weeks for public review, prior to adoption. Responses to questions and revisions to the DDA will be posted, along with the new statutory documents, for public review for a two-week period, in advance of the 15th of December. At the meeting of December 15, 1993, a recommendation to adopt the agreement will be made.
