PUBUC STATEMENTS CONSENI'CAI;NDAR ae Approval of Voucher Nos. 58 through 78 inclusive, in the amount of $5,252.09. Minutes of the Regular Meeting of November 29, 1993 and Special Meeting of December 15, 1993. Motion by Cohrs to adopt Items (a) and (b) of the Consent Calendar. APPROVED AB ARAUJO LINDSAY MOREA Design Review Committee Report No. 94-1 regarding K Street Improvements and city Parking Lot at 19th and K Streets. Motion by Sceales to accept Report. APPROVED AB ARAUJO LINDSAY MOREA Design Review Committee Report No. 94-2 regarding Community First Bank Office Project at 1400 lSth Street. Motion by Sceales to accept Report. R~O~ continued ACTION TAKEN Executive Director Oral Report No. 94-1 regarding Status of the Bakersfield Convention Center Hotel. Executive Director Tandy provided updated information: The Grant Application has been transmitted and assigned to Washing- ton D.C.; The Personal Guarantee documents will be executed before the end of the week; The Disposition and Development Agree- ment will be executed with a few minor amendments and with one exception; Taxable portions of the bonds will be picked up directly by the developer, rather than under the city's pool umbrella, leaving the Ballroom/Meeting Room section and the $3 million tax- exempt portion with confirmation by the end of the week; The developer is unwilling to sign the portion of the DDA which indemnified the City at the developer's expense or a prevailing wage challenge. city Manager Tandy will present to city Council two proposed changes to the DDA at the Council meeting of January 12, 1994: 1) Reverse the indemnification; 2) City to exempt itself from the prevailing wage law. Executive Director Tandy suggested Agency call a Special Meeting for January 13, 1994, if necessary, to approve a revised DDA. Acting city Attorney Skousen explained the possible risk of reversing the liability clause, and potential litigation. Bakersfield, California, January 3, 1994 - Page 3 79 4. R~PO~F~ continued ACTION TAKEN Presentation by David Williams, Vice President of office Properties for Charles Tingey Associates, regarding the Downtown Office Market and its relation to the rest of Bakersfield. David Williams provided a slide presentation and submitted a written summary. 5. UNfiNISHED BUSINESS 6 o NEW BUSINESS ae Amendments to the Brown Act and its impact on Central District Development Agency. Acting City Attorney Skousen reviewed the amendments to the Brown Act, effective April 1, 1994. Election of Central District Development Agency chairperson and Vice-Chairperson for Calendar Year 1994. Gaskill suggested, and present Agency Members concurred, to defer this item to the meeting of February 14, 1994, due to the absence of three (3) Agency Members this evening. 7. AGENCY STATEMENTS Motion by Gaskill to recess to Closed Session at 5:00 p.m. APPROVED AB ARAUJO LINDSAY MOREA CLOSED SESSION Closed Session pursuant to Government Code Section 54956.9(b)(1) regarding potential litigatlon.
