HomeMy WebLinkAboutRES NO 78-95RESOLUTION NO. ? 8 ' 9 5 A RESOLUTION DETERMINING THAT DESIGN AND INSTALLATION OF A LANDFILL GAS MANAGEMENT SYSTEM AT THE BAKERSFIELD LANDFILL CANNOT BE REASONABLY OBTAINED THROUGH USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR, NOT TO EXCEED $212,179; AND APPROPRIATION OF FUNDS. WHEREAS, City has previously installed a gas collection system at the Bakersfield Landfill and said system has proved inadequate; and WHEREAS, it is necessary immediate steps be taken to control landfill gas; and WHEREAS, City has been issued an order from Kern County Environmental Health to take steps to control the migration of landfill gas; and WHEREAS, City desires to design and install a gas control system that can make use of components of the current system for cost savings, will be compatible with previous studies and tests, and will conform to requirements revealed by planned studies and tests yet to be performed; and WHEREAS, City desires to successfully integrate such environmental and landfill work, supplies, equipment and materials into said existing City project and system; and WHEREAS, City desires to employ Kleinfelder Company to design and install a landfill gas management system; and WHEREAS, Kleinfelder Company represents that they are experienced and well qualified in the field of landfill gas control; and WHEREAS, the Public Works Director recommends the Council find that said work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor because of the need to successfully integrate such work, supplies, equipment and materials into the existing City system and recommends this Council authorize the Finance Director to dispense with bidding; and WHEREAS, the Finance Director recommends the Council find said project's work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor as per the Public Works Director recommendation and recommends the Council dispense with bidding under subsection D.1. of Section 3.20.060 of the Bakersfield Municipal Code. ORIGINAL NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above-recitals are true and correct and incorporated herein by reference. 2. The work, supplies, equipment and materials cannot be reasonably obtained from more than one vendor because of the need to successfully integrate the work, supplies, equipment and materials into an existing City project and system. 3. The Finance Director is authorized to dispense with bidding in accordance with subsection D.1. of Section 3.20.060 of the Bakersfield Municipal Code. 4. The appropriation of balance to the Public Works Capital Refuse Fund is approved. $212,179 from the Refuse Fund Improvement budget within the 5. The Mayor is authorized to execute a contract, as approved by City staff, with Kleinfelder Company. 6.
