BETTING TIME AND PLACE OF HF, i~RING THEREON
RESOLVED BY THE CITY COUNCIL (the "Council") OF THE CITY
OF BAKERSFIELD (the "city"), as follows:
WHEREAS, the Council, on January 12, 1994, adopted
Resolution of Intention No. 1112 with regard to the construction
and/or acquisition of improvements (the ,,Improvements") for city of
Bakersfield Assessment District No. 1993-2 (the "District") and
levied an assessment therefor pursuant to Resolution No. 33-94,
adopted March 9, 1994; and
WHEREAS, the owners of certain lands within the District
and subject to assessment, originally identified as Assessment Nos.
3, 4, and 451 on the assessment roll approved as part of the
Proceedings (the ,,Assessment Roll"), have filed a written
application with the City requesting that the assessments levied
upon said properties be reapportioned in accordance with three duly
recorded final subdivision maps for said properties, copies of
which are on file with the City; and
WHEREAS, such reapportionment is also referred to as a
division of land and bond and is authorized pursuant to Part 10.5
of Division 10 (commencing with Section 8740) of the California
Streets and Highways Code (the "Code"); and
WHEREAS, the original purchasers of the City of
Bakersfield Assessment District No. 1993-2 Limited Obligation
Improvement Bonds (the "Bonds") have been given notice that a
division of land and bond is to be made; and

WHEREAS, the owner(s) of that certain property formerly
identified as Assessment Nos. 3, 4, and 451, as shown on the
Assessment Roll, have requested that said existing assessments be
divided and the unpaid installments be apportioned among the
resulting amended assessments; and
WHEREAS, title to certain of the proposed amended
assessments may have been transferred pursuant to the proposed
division of those existing assessments, and may now be owned by
persons who have not had notice nor an opportunity to be heard
regarding the segregated and apportioned installments which will
become a lien against their individual amended assessments; and
WHEREAS, this City Council wishes to afford the new
property owners notice and an opportunity to be heard; and
WHEREAS, the actions contemplated bythis resolution will
not effect the other lands within the District or the assessments
levied thereon and will not increase the aggregate assessment for
the District, nor will the aggregate assessment for each of the
existing assessments be increased; and
WHEREAS, in connection with the division of land and bond
for existing Assessment Nos. 3, 4 and 451, an amended engineer's
report for the District, an amended assessment roll for the
District and an amended assessment diagram for the District shall
be prepared for each existing assessment and filed with the City.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
ORDERED AS FOLLOWS:
1. The foregoing recitals are hereby incorporated
herein and made a part of this resolution.
2. The Engineer of Work is directed to prepare the
amended engineer's report for the District, amended assessment
rolls Nos. 7, 8, and 9 and amended assessment diagrams Nos. 7, 8,
and 9 for the District (collectively, the "Amendments"), each
prepared in connection with the proposed division of land and bond,
copies of which shall be filed with the city Clerk.
3. Wednesday, June 14, 1995, at the hour of 7:00 p.m.,
in the regular meeting place of the Council, being the Council
Chambers, 1501 Truxtun Avenue, Bakersfield, California, be and the
same are hereby fixed as the time and place when and where this
Council will hear and consider protests to the amended assessment
and segregation and apportionment of the unpaid installments of the
original assessment. At the time of said hearing, all persons
interested in the original assessment or in the land affected or
the bonds secured thereby may appear and protest the amended

4. Upon the filing of the amended report, amended
assessment rolls and amended assessment diagrams, the city Clerk is
hereby directed to give notice of said hearing on the report and
amended assessments by publication twice, on separate days, in the
Bakersfield Californian, a newspaper of general circulation
published and circulated in said City. The first publication of
such notice shall occur not less than fifteen (15) days prior to
the hearing.

AND FIXING TIME AND PLACE OF HEARING THEREON
CITY OF BAKERSFIELD
ASSESSMENT DISTRICT NO. 93-2
WHEREAS, on May 17, 1995, the City Council of the City of
Bakersfield, California, did pass its Resolution directing the
Engineer of Work to prepare and file an Amended Assessment for
existing Assessment Nos. 3, 4, and 451, as set forth in the
Engineer's Report and Assessment for Assessment District No. 93-2,
which was originally recorded in the office of the Superintendent
of Streets for the City of Bakersfield on March 9, 1994; and
WHEREAS, the Engineer of Work for Assessment District
No. 93-2 has filed with the City Clerk of the City of Bakersfield
a report and Amended Assessment Rolls and Diagrams Nos. 7, 8, and
9, amending existing Assessment Nos. 3, 4, and 451 hereinabove
referred to, by division of said parcels into new Assessment Nos.
451 through 553 inclusive, including maps or plats showing how said
lots or parcels have been divided.
WHEREAS, the unpaid installments of the original
assessment for the existing Assessment Nos. 3, 4, and 451 is
proposed to be segregated and apportioned to the new Assessment
Nos. 451 through 553 inclusive.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN to all persons
interested in the original assessment, or in the lands affected
thereby, or in the bonds secured thereby, that a hearing will be
held on June 14, 1995, at the hour of 7:00 p.m., at the regular
meeting place of the City Council of the City of Bakersfield
located in the Council Chambers, City Hall, 1501 Truxtun Avenue,
Bakersfield, California, at which time the Council shall hear and
determine all objections to the division of the assessments and the
segregation and apportionment of the unpaid installments, and shall
consider all objections to said amended assessments herein.
For further particulars, reference is hereby made to the
report of the Engineer of Work and the maps or plats of theAmended

PURSUANT TO RECORDATION OF TRACT NO. 5688 PHASE C
An application has been filed with the Superintendent of Streets of the City of Bakersfield, requesting an
apportionment of assessments within Assessment District No. 93-2 to conform with the subdivision of land
within the district.
In accordance with the application, the undersigned hereby apportions to each separate part of the original
parcels of land, the proportionate part of the assessment that would have been levied thereon if the parcels had
been so divided at the time the original assessment was made. The undersigned has assigned a new assessment
number to each new parcel, as shown on the Amended Assessment Diagram attached to this apportionment.
The existing assessment numbers, new assessment numbers and apportioned assessments (based in each case
on the unpaid principal amount of assessment effective March 1, 1994, for the 1994/95 Tax Year) are as
shown on Exhibit "A", Amended Assessment Roll attached hereto and incorporated herein by reference. A
description of the referenced old assessments and of how they have been subdivided or mconfigured is included
in Exhibit "B", attached hereto. A description of the procedure used to apportion the unpaid principal for the
referenced old assessments to the new assessments is included in Exhibit "C", attached hereto.

ASSESSMENT AND DIAGRAM AMENDMENT NO. 8
Existing Assessment 3 is located within the northem area of Assessment District No. 93-2 (A.D.
93-2). The location within A.D. 93-2 is shown on Sheets 1 and 2 of the Amended Assessment
Diagram for this assessment apportionment proceeding. Existing Assessment 3 was assessed for
its share of the acquisitions acquired with this A.D. 93-2.
Existing Assessment 3 has been subdivided by the recordation of Tract No. 5688 Phase C. The
configuration of the existing Assessment 3 is shm~ on Sheets I and 2 of the Amended Assessment
Diagrams. The boundary of Assessment 3 includes Tract No. 5688 Phase C and a remainder
parcel. Assessment 3 is Parcel 3 of Parcel Map No. 9919.
The original portion of the existing Assessment 3 was apportioned as follows:
Existing Assessment 3 was subdivided by Tract No. 5688 Phase C to create 58 new residential lots
and a remainder parcel.
Existing Assessment 3 was apportioned by area to the remainder parcel and to Tract No. 5688
Phase C by multiplying the percent of the total area of each by the assessment amount for
Assessment 3 ($188,885.60). The remainder parcel was assigned new Assessment Number 473.
The assessment to Tract No. 5688 Phase C was then apportioned equally to each of the 58 new
residential lots since each of these residential lots will benefit equally from the acquisitions. The 58
new parcels were assigned new Assessment Numbers 474 through 531.

1. An application has been filed with the Superintendent of Streets of the City of Bakersfield, requesting an
apportionment of assessments within Assessment District No. 93-2 to conform with the subdivision of land
within the district.
In accordance with the application, the undersigned hereby apportions to each separate part of the original
parcels of land, the proportionate part of the assessment that would have been levied thereon if the parcels had
been so divided at the time the original assessment was made. The undersigned has assigned a new assessment
number to each new parcel, as shoxvn on the Amended Assessment Diagram attached to this apportionment.
The existing assessment numbers, new assessment numbers and apportioned assessments (based in each case
on the unpaid principal amount of assessment effective March 1, 1994, for the 1994/95 Tax Year) are as

Phase F by multiplying the percent of the total area of each by the assessment amount for
Assessment 451 ($143,927.20). The remainder parcel was assigned new Assessment Number 532.
The assessment to Tract No. 5688 Phase F was then apportioned equally to each of the 21 new
residential lots since each of these residential lots will benefit equally from the acquisitions. The 21
new parcels wem assigned new Assessment Numbers 533 through 553.

I herewith state that the Amended Assessments shown on Engineer's Report Exhibit "A", Amended Assessment
Roll, have been calculated as described herein and are apportioned to each parcel in direct proportion to the
estimated benefits each parcel will receive from the AD 93-2 Improvements, based on current parcel amended land
uses. Based on the data presented herein with regard to the proposed amended parcel assessments and parcel
appraised values, it is the finding of this Enginecr's Report that approval of the Amended Parcel Assessments
shown on said Exhibit "A" will not adversely affect the security for the AD 93-2 Bond.
