HomeMy WebLinkAboutRES NO 75-95RESOLUTION NO. ? $ - 9 5 A RESOLUTION AUTHORIZING THE BAKERSFIELD CITY FIRE DEPARTMENT TO ENFORCE AB 13 WHICH PROHIBITS SMOKING IN ENCLOSED PLACES OF EMPLOYMENT. WHEREAS, on July 21, 1994, the Governor of the State of California signed into law AB 13 which generally prohibits smoking in enclosed places of employment; and WHEREAS, the non-smoking provisions of AB 13 shall be enforced by local law enforcement agencies including, but not limited to, local health departments, as determined by the local governing bodies; and WHEREAS, the City Council desires to empower a City department to enforce the provisions of AB 13; and WHEREAS, the City Council has determined that the appropriate department to be given the responsibility for enforcement of AB 13 is the City of Bakersfield Fire Department. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The City of Bakersfield Fire Department is hereby empowered to enforce the provisions of AB 13 providing for the regulation of smoking in enclosed places of employment. 2. The City of Bakersfield Fire Department is hereby further empowered to utilize all enforcement measures necessary to carry out the provisions of AB 13 within the jurisdictional limits of the City of Bakersfield. .......... 000 ..........
