HomeMy WebLinkAbout08/07/89 MINUTES RABakersfield, California, August 7, 1989 Minutes of the Regular Meeting of the Central District Development Agency of the City of Bakersfield, California, held in the Council Chambers of City Hall, 1501 Truxtun Avenue, at 3:00 p.m., August 7, 1989. The meeting was called to order by Chairperson Dunn. City Clerk Williams called the roll as follows: Present: Agency Members Dunn, Kronenberg, Paynter, Rubin, Watson, Araujo Absent: Agency Member Killmer CONSENT CALENDAR The following items were listed on the Consent Calendar: Approval of Warrant Nos. 0001 to 0026 inclusive, in the amount of $223,385.08. Minutes of the Regular Meeting of July 17, 1989 for approval. Notice of Completion and Acceptance of Work for "K" Street reconstruction and signal improvements at "K", "L", 17th and 18th Streets, City Contract No. RA89-2, was completed on July 21, 1989. Notice of Substantial Completion for the Civic Auditorium Expansion and Remodel. Upon a motion by Agency Member Kronenberg, Item a, b, c and d of the Consent Calendar were approved by the following roll call vote: Ayes: Agency Members Araujo, Dunn, Kronenberg, Paynter, Rubin, Watson None None Agency Member Killmer Noes: Abstain: Absent: REPORTS Agency Member Rubin, Chairperson of the Housing, Relocation, and Communications Committee, read Report No. regarding Appraiser Selection Policy as follows: After a thorough examination of the methods available to select appraisers used by the Agency, this committee has arrived at a policy which meets the needs of all parties concerned. 89-6 Bakersfield, California, August 7, 1989 - Page 2 The Agency needs to be assured that any appraiser is well-qualified and can provide an appraisal in a reasonable time at a fair price. The City Attorney's Office, too, must be satisfied the appraiser has excellent qualifications as the issue of eminent domain and subsequent court involvement is always a possibility in redevelopment. And the appraiser community must feel comfortable that selection is being done in a fair manner. With these goals in mind the Housing, Relocation, and Communications Committee recommends the following policy be adopted: Because eminent domain is always a potential issue in redevelopment, the City Attorney's office will make the final decision regarding which appraiser is chosen, based upon the particulars of each situation. This decision will involve close contact with Agency staff to determine the purpose of the appraisal, the location of the property, and the time requirements involved. The City Attorney's office will write a retainer letter to the appraiser, authorizing the work being requested in order to secure the attorney work product privilege for the appraisals. Appraisals will be submitted to the City Attorney's office. The Agency staff will annually compile a list of the appraisers retained, the hourly fee, the number of hours charged, along with such staff comments as may be appropriate for review by the Housing, Relocation, and Communications Committee. The Housing, Relocation, and Communications Committee recommends the Agency adopt this policy regarding the selection of appraisers. Upon a motion by Agency Member Rubin, Housing, Relocation, and Communications Committee Report No. 89-6 was accepted. Upon a motion by Agency Member Kronenberg, the recommen- dations within Housing, Relocation and Communications Committee Report No. 89-6 were implemented. Bakersfield, California, August 7, 1989 - Page 3 AGENCY STATEMENTS Chairperson Dunn asked staff for an update regarding negotiations with Terry Moreland concerning the 22nd and Eye Street parcel. Assistant City Attorney Daniel provided an update. Economic Development Director Wager introduced staff members Donna Barnes, Economic Development/Community Development Associate, liaison to the Housing, Relocations and Communications Committee; and Andre Devereaux, Development Assistant, liaison to the Historic Preservation Commission and support to senior staff members for the update of the Redevelopment Element. CLOSED SESSION Closed Session pursuant to Government Code Section 54956.9(a) regarding Morelandt et al. v. Mead, KCSC Case No. 199597. Closed Session pursuant to Government Code Section 54956.9(a) regarding bankruptcy of the Clarion Hotel Project.
