HomeMy WebLinkAbout02/21/89 MINUTES RA240 Bakersfield, California, February 21, 1989 Minutes of the Regular Meeting of the Central District Development Agency of the City of Bakersfield, California, held in the Council Chambers of City Hall, 1501Truxtun Avenue, at 3:00 p.m., February 21, 1989. The meeting was called to order by Vice Chairperson Paynter. Deputy City Clerk Zaragoza called the roll as follows: Present: Agency Members Araujo, Kitlmer, Kronenberg, Rubin Absent: Agency Members Dunn, Watson Paynter, MINUTES Upon a motion by Agency Member the Regular Meeting of February 6, 1989 Kronenberg, Minutes were approved. of BILLS AND CORRESPONDENCE Upon a motion by Agency Member Killmer, Warrant Nos. 182 to 208 inclusive, in the amount of $57,676.41 were approved by the following vote: Ayes: Agency Members Araujo, Killmer, Kronenberg, Paynter, Rubin Noes: None Abstain: None Absent: Agency Members Dunn, Watson REPORTS Agency Member Kronenberg, Chairperson of the Design Review Committee, read Report No. 89-2 regarding an application by Alfonso De Alba (Azteca Shoe Store) for new signage at 1419 19th Street as follows: The Design Review Committee, on February 9, 1989, reviewed the application by Azteca Shoe Store for new signage at a builOing located at 1419 19th Street. The sign is 8' x 5' in size, white background with red letters reading "Azteca Shoe Store" and constructed with plastic material. Agency Member Kronenberg, Design Review was accepted and the recommendations Agency Member Kronenberg, Chairperson of Ihe Design Review Committee, read Report No. 89-3 regarding an application by Guarantee Shoe Center for exterior building color change and revised signage for a structure located at 2101 Chester Avenue as follows: On February 9, 1989 the Design Review Committee reviewed the application by Guarantee Shoe Center for exterior building color change and revised signage for a structure located at 2101 Chester Avenue. The exterior color change consists of four different shades of Lavender Cloud, Cranberry Wine, Brandy Wine, and Aqua Green. The signs facing 21st Street and Chester Avenue are 8' x 8' in size and reads Guarantee Shoe Center. The sign colors are the same and are coordinated with the building colors. The Committee approved the application as submitted and recommends that the Agency do likewise. Upon a motion by Agency Member Kronenberg, Design Review Committee Report No. 89-3 was accepted and the recommendations were implemented. Agency Member Kronenberg, Chairperson of the Design Review Committee, read Report No. 89-4 regarding an application by Tips and Toes Nail Salon for approval of additional new signage at 1517 21st Street as follows: On February 9, 1989 the Design Review Committee reviewed the application by Tips and Toes Nail Salon for approval of new signage at a building located at 1517 21st Street. The sign is 9'3" in length by 3' in width. The sign letters are a cut out foam plastic material with a rust textured brick color. 242 Bakersfield, California, February 21, 1989 Page 3 The Committee recommends approval of the sign as submitted. It is recommended that the Agency also approve this application. Upon a motion by Agency Member Kronenberg, Design Review Committee Report No. 89-4 was accepted and the recommendations were implemented. Agency Member Kronenberg, Chairperson of the Design Review Committee, read Report No. 89-5 regarding an application by Brokers of Bakersfield for signage at a building located at 923 17th Street as follows: On February 9, 1989 the Design Review Committee considered the application by Brokers of Bakersfield for signage at a building located at 923 17th Street. The two signs are 2' x 6' in size. The duraply sign will be wall mounted with a 2" x 2" wood frame. Colors will be tan and brown. The Committee approved the two signs as submitted, one to be placed above the other on the front masonary wall. The top of the upper sign shall be a least 8' above the sidewalks. The Committee recommends that the Agency also approve this sign application. Upon a motion by Agency Member Kronenberg, Design Review Committee Report No. 89-5 was accepted and the recommendations were implemented. NEW BUSINESS Oral presentation by Ran Brummett regarding Route 178 Corridor Study, and discussion of one-half cent sales tax. Mr. Ran Brummett, Kern COG, briefed the Agency on the 178 Corridor Study and displayed a map showing the project. Mr. Brummett explained the proposed Measure "A," and stated that Measure "A" would provide a minimum of 2 million dol- lars a year to the City of Bakersfield for its local streets and roads. The 178 Corridor Study is one of the projects that will be constructed from funds from Measure "A" if it is passed. Bakersfield, California, February 21, 1989 - Page 4 243 Upon a motion by Agency Member Kronenberg, the Agency stated their support of endorsing the passage of the one-half cent sales tax. Award of bid for 19th and Chester Avenue Improvement Plan. Upon a motion by Agency Member Araujo, award of bid for 19th and Chester Avenue Improvement Plan was referred to the Design Review Committee. Agency Member Araujo requested that a representative from the Downtown Business Association attend the Design Review Committee meeting on Thursday, February 23, 1989. Agency Member Paynter requested that a representative from the Public Works Department attend the Design Review Committee meeting on Thursday, February 23, 1989. Approval of Contract No. RA89-2 with Granite Construction for offsite improvements in conjunction with the City Center Project. Economic Development Director Wager briefed on the bids received for the offsite improvements in with the City Center Project. the Agency conjunction Upon a motion the amount of $117,991 the other bid rejected, execute the contract. by Agency Member Killmer, the low bid in from Granite Construction was approved, and the Executive Director authorized to Paul Shillcock, Principal Planner, stated that Staff has discussed the issue of moving the curb out two feet on 17th Street with the Developer. The Developer will be discussing this concern with his Engineer and will report back to Staff. Agency Member Paynter asked that Staff follow-up on this issue and report back to the Agency. Discussion of the Brown Act. Agency Member Kronenberg stated that 1he Agency expressed some concern as to whether a Closed Session should be an item on every Agenda and if "approval of the agenda" prior to beginning each meeting would be a useful, practical process. 244 Bakersfield, California, February 21, 1989 - Page 5 Assistant City Attorney Daniel stated that the Attorney's Office continues to recommend that the "Closed Session" not be pieced on the Agenda each time; and there necessity to approve the Agenda prior to the start of the meeting. is no He stated that approving the Agenda prior to the meeting is not a requirement of the Brown Act, and feels posting the Agenda is sufficient. Assistant City Attorney Daniel also stateO that placing a "Closed Session" on every Agenda and orally announcing the Code Section is allowable under the Brown Act. He Stated that the problem the Attorney's Office has with this is that it is not the most conservative approach. He said there are several ways to go into a Closed Session and there is an issue as to whether or not proper notice has been given to the public. Assistant City Attorney Daniel stated that in order to avoid any possibility of a law suit, a Closed Session should only be placed on the Agenda when there is an issue, and it should state the code section. Agency Member Killmer asked Staff to review placing a Closed Session on every Agenda more thoroughly. Agency Member Kronenberg requested Staff to contact California Redevelopment Association to find out how many Redevelopment Agencies use this technique. the AGENCY STATEMENTS Economic Development Director Wager stated that Agency Members Dunn, Kronenberg, Paynter, and Staff members Art Hartenberger and Jake Wager will be visiting Stockton, California. The purpose of the trip is to exchange information with Stockton Redevelopment officials. Agency Member Kronenberg requested Staff be sure the American National Bank building is inspected by the Building Department before the Police Department uses it. CLOSED SESSION Closed Session pursuant to Government Code Section 54956.9(b) regarding the Clarion Hotel Project.
