HomeMy WebLinkAbout05/09/88 MINUTES RABakersfield, California, May 9, 1988 151 Minutes of the Regular Meeting of the Central District Development Agency of the City of Bakersfield, California, held in the Council Chambers of City Hall, 1501 Truxtun Avenue, at 3:00 p.m., May 9, 1988. The meeting was called to order by Chairperson Watson. City Clerk Williams called the roll as follows: Present: Agency Members Watson, Dunn, Kronenberg Absent: Agency Member Killmer Araujo, Paynter, Rubin PUBLIC STATEMENTS Mr. Ken Reed, Board of Directors, Downtown Business Association, spoke regarding the May 3, 19th Street Workshop. Mr. Reed stated that they are very enthusiastic to see the first steps taken to carry out the physical improvements of the down- town streetscape. Mr. Reed also stated that those present at the May 3 meeting expressed that they would like the Agency to arrange for two or three qualified Downtown Business Association representa- tives to meet with the Agency to review various important aspects of the intersection designs as the details are prepared. BILLS AND CORRESPONDENCE Upon a motion by Agency Member Araujo, Warrant Nos. 375 to 399 inclusive, in the amount of $2,636.01, were approved by the following vote: Ayes: Noes: Absent: Agency Members Watson, Dunn, Kronenberg None Agency Member Killmer Araujo, Paynter, Rubin, Upon a motion by Agency Member Kronenberg, communication from the Bakersfield Art Foundation, P.O. Box 1911, dated March 19, 1988, expressing interest in having representation on the panel investigating the creation of an Arts Center, was received and referred to the Development Committee. REPORTS Agency Member Paynter, Chairperson of the Design Review Committee, read Report No. 88-29 regarding signage for a building at 2000 Chester Avenue (The Shoe Collection), as follows: On April 21, 1988 the Design Review Committee considered a request from the subject applicant for reconsideration of replacement signage for the building located at 2000 Chester Avenue. 152 Bakersfield, California, May 9, 1988 - Page 2 The Committee agreed to reconsider the previously approved signage. In this regard, the Committee recommends that the Agency approve the reconsideration request by Mr. Gross. Upon a motion by Agency Member Committee Report No. 88-29 was accepted, implemented. Paynter, Design Review and the recommendations Agency Member Paynter, Chairperson oX the Design Review Committee, read Report No. 88-30 regarding signage for a building located at the southeast corner oX 23rd and "M" Streets as follows: On April 21, 1988 the Design Review Committee reviewed the application ~or signage at a structure located at 23rd and "M" Streets. The Committee approved the signage and building color scheme as submitted. In addition, the signage should not exceed 32 square feet, per code regulation. All signs are to be o~ pro~essional quality. The Committee submits this report ~or approval by the Agency. Upon a motion by Agency Member Paynter, Design Review Committee Report No. 88-30 was approved. Agency Member Paynter, Chairperson of the Design Review Committee, read Report No. 88-31 regarding signage for a building located at 1430 Truxtun Avenue (Bank o~ America Tower) as follows: On April 21, 1988 the Design Review Committee reviewed the application tor signage at a building located at 1430 Truxtun Avenue. The Committee approved a temporary sign for Signs Unlimited which will replace the existing "For Lease" sign. The new sign is not to exceed 4' x 4' in size and be no taller than 48" above the retaining wall at the back side o~ the landscape planter. This sign shall be a double race sign. The Committee recommends that the Agency approve this report. Upon a motion by Agency Member Paynter, Design Review Committee Report No. 88-31 was approved. Bakersfield, California, May 9, 1988 - Page 3 153 Agency Member Paynter, Chairperson of the Design Review Committee, read Report No. 88-32 regarding Master Tree Planting Plan for Downtown as follows: On April 21, 1988, the Design Review Committee reviewed a presentation from Don Hoggatt, of the City Public Works Department, regarding preliminary landscape plans for Chester Avenue and existing landscape development standards for the Downtown. Upon receiving this presentation, the Design Review Committee recommends to the Central District Development Agency a "Master Tree Planting Plan for Downtown" be prepared. Further, it is recommended that the Development Committee consider the formulation o~ such a plan in its discussion of downtown improvements, and if that Committee concurs, the Central District Development Agency should request the Public Works Department, of the City of Bakersfield, to prepare this plan. Said plan should include implementation and maintenance costs, and be prepared at the earliest possible time. Upon a motion by Agency Member Paynter, Design Review Committee Report No. 88-32 was referred to the Development Committee. Agency Member Rubin read Development Committee Report No. 88-8 regarding proposed downtown improvements as follows: On May 9, 1988, the Development Committee met to discuss proposed downtown improvements and the input received at the workshop held on May 2, 1988, for downtown business persons and property owners. After thorough discussion of all aspects proposed, it is the recommendation of the Development Committee that the Agency immediately undertake the improvement ot the intersection o~ Chester Avenue and 19th Street in accordance with the recommendations for street surface treatment and landscaping included in the Archiplan proposal. The materials and varieties of landscaping will be in keeping with the standards currently being established by the Design Review Committee. Upon a motion by Agency Member Rubin, the recommenda- tions stated in Development Committee Report No. 88-8 were accepted. 154 Bakersfield, California, May 9, 1988 - Page 4 NEW BUSINESS Presentation by Kane, Ballmer and Berkman regarding representation of the Central District Development Agency in legal matters. Mr. Bruce Tepper, partner in the law firm of Kane, Ballmer and Berkman, explained the background of their law firm and named cities that they represent. Mr. Tepper briefed the Agency on their area of expertise in litigation in redevelop- ment. Mr. Glen Waserman, partner in the law firm of Kane, Ballmer and Berkman, spoke regarding their expertise in business and projects they have worked on. Deputy City Attorney Daniel recommended immediate appointment of the firm Kane, Ballmer and Berkman. Chairperson Watson made a motion to refer the contract for legal services from the law firm of Kane, Ballmer and Berkman to the City Attorney's Office for review, and to come back to the Agency at the next meeting. Approval of Resolution No. RA3-88 of the Central District Development Agency o~ the City of Bakersfield approving and adopting an Indemnity Agreement between Ticor Title Insurance Company and the Central District Development Agency. Upon a motion by Agency Member Paynter, Resolution No. RA3-88 of the Central District Development Agency of the City of Bakersfield, was adopted by the following vote: Ayes: Noes: Absent: Agency Members Watson, Dunn, Araujo, Paynter, Kronenberg, None Agency Member Killmer Rubin, Status report on rehabilitation/ demolition of the Tegler Hotel. Paul Shillcock, Interim Economic Development Director, stated that they were not able to contact the agent from the County Health Department, or the owner of the Tegler Hotel. Mr. Shillcock also stated that the Building Department has not received the release from the the County Health Department at this time, therefore, no building permit can be issued. Bakersfield, California, May 9, 1988 - Page 5 155 Chairperson Watson requested that an updated memorandum regarding the Tegler Hotel be provided to the Agency prior to the next Agency meeting. Reconsideration of a portion of construction plans and interior furnishing for architectural review on Clarion Hotel. Upon a motion by Agency Member Dunn, reconsideration of a portion of construction plans and interior furnishing for architectural review on Clarion Hotel was referred to the Design Review Committee. Agency Member Paynter invited anyone from the public who is interested in reviewing the plans to attend the next Design Review Committee meeting. Agency Member Kronenberg requested that the construction plans and interior furnishings on the Clarion Hotel be available at the Economic Development office ~or review. Status report on Community First Bank Project. Mr. Gregory Bynum presented the conceptual model and gave an overview ot the Community First Bank Project. Mr. Bynum requested a 30-day extension on the Exclusive Right to Negotiate. Mr. Watson clarified that the 30-day extension would begin from May 2, 1988. Approval ot Agreement No. RA88-5, Amendment to the Exclusive Right to Negotiate between the Central District Development Agency and Gregory D. Bynum and Associates. Upon a motion by Agency Member Kronenberg, Agreement No. RA88-5, was approved. Chairman Watson stated for the record that Agency Member Rubin abstained from voting due to possible conflict of interest. Assistant City Manager Pulskamp introduced Paul Shillcock as the Interim Economic Development Director. Assistant City Manager Pulskamp suggested that the issue of extending the Redevelopment Area boundaries be referred to the Development Committee ~or further study. Upon a motion by Agency Member Paynter, the issue of extending the Redevelopment Area boundaries was referred to the Development Committee. Agency Member Araujo made a motion to ask Chairperson Watson to write a letter of congratulations to the persons involved in the Library project. 156 Bakersfield, California, May 9, 1988 - Page 6 Agency Member Kronenberg requested that a status report on the Moreland Lawsuit be placed on the next agenda.
