HomeMy WebLinkAbout06/20/88 MINUTES RABakersfield, California, June 20, 1988 169 Minutes of the Regular Meeting of the Central District Development Agency of the City of Bakersfield, California, held in the Council Chambers of City Hall, 1501 Truxtun Avenue, at 3:00 p.m., June 20, 1988. The meeting was called to order by Chairperson Watson. Deputy City Clerk Gafford called the roll as follows: Present: Agency Members Dunn, Killmer, Kronenberg, Rubin, Watson, Araujo Absent: Agency Member Paynter MINUTES Upon a motion by Agency Member Araujo, Minutes of Regular Meeting of June 6, 1988 were approved as corrected. the PUBLIC STATEMENTS Bruce Keith, Second Vice-President, DBA, 1820 Brundage Lane, No. C, read a prepared statement regarding prioritizing major projects downtown as follows: The Downtown Business Association believes it's imperative the C.D.D.A. undertake steps as soon as possible to establish an orderly process for the receipt of redevelop- ment proposals and their prioritization. To succeed in any endeavor it is important to prioritize one's activities relative to one's goals and resource limits. With redevelopment, money, tenants and land are limited resources. The C.D.D.A. only has so much money to spend on new projects each year. New offices can only be absorbed by the market so fast and desirable sites are limited. To achieve the goal of redeveloping Downtown, it is imperative that the C.D.D.A. adopt a policy which will serve to prioritize projects. Possible elements of that policy mights be as follows: Projects that require less C.D.D.A. money than others should be given a higher priority. When the C.D.D.A. has given a developer an exclusive right to negotiate with property owners, No other developers should be given such rights until the original developer has been deemed to have succeeded or to have Called. 170 Bakersfield, California, June 20, 1988 - Page 2 The properties within the development area should be surveyed and evaluated as to those areas that are in the most need to those areas that are in the least need. Then the projects that include those areas in the most need should be prioritized ahead of those in the least need. As structured now, a developer may approach the C.D.D.A. at any time with a project proposal. A policy should be adopted which sets a date annually when the C.D.D.A. will receive proposals. These proposals might include the following: Announce the availability of funds for redevelopment. The specific amount available should be identified. b. Establish a deadline for acceptance of proposals. Develop a "Project Evaluation Procedure" so projects can be scored and ranked. This procedure should be made available to developers so they can use it in the development of their proposals. When a proposal has been accepted and funds reserved for it, establish performance milestones that a developer must meet to maintain his exclusive rights. If a developer fails, the funds identified for that project could be carried forward and made available to the next cycle of funding, or they could be offered to another developer who had submitted a proposal for the same funding cycle. BILLS AND CORRESPONDENCE This item was deferred until clarification from staff on Warrants from Adams, Duque & Hazeltine. REPORTS Agency Member Kronenberg, Chairperson of the Relocation and Public Relations Committee read Report No. 88-7 regarding the recommendation to accept bid from Griffin Communications for the annual contract to produce "Blueprints" as follows: On March 21, 1988, this Agency adopted an open bidding process to seek a contractor for the production of "Blueprints," the Agency's quarterly newsletter. Such a process required that this Committee review all bids and present a recommendation for the awarding of a contract. Bakersfield, California, June 20, 1988 - Page 3 171 A formal bid solicitation procedure was instituted by the City's Purchasing Department which sought bids from all interested vendors. Two bids were received as follows, based upon a quarterly publication of 3,000 copies per issue. Sierra Printers 1-color 2-color $1,462.00 1,631.00 Griffin Communications 2-color 1,748.00 Current issues are two-color publications. The Agency is not under obligation to choose the lowest bid, but instead, may consider other factors in selecting a vendor. The bid received from Griffin Communications was only slightly higher than that of Sierra. The Committee recognizes the quality of work performed by Griffin Communications to date in producing "Blueprints" and the close working relationship that city staff and the vendor have developed. The Committee also considered vendor location within the redevelopment area. Because of these reasons the Committee is recommending the Agency accept the bid from Griffin Communications and let the contract be for one (1) year. Approval of Contract No. RA88-14 with Griffin Communications. Upon a motion by Agency Member Kronenberg, Relocation and Public Relations Committee Report No. 88-7 was accepted and recommendations implemented. Agency Member Rubin, read Development Committee Report No. 88-13 regarding Moreland Corporation proposed downtown retail/office complex as follows: During the CDDA meeting of June 6, 1988, Mr. Terry Moreland provided an oral presentation on a proposed retail/office complex to be located on a site bounded approximately by Chester Avenue, 19th, "M", and 23rd Streets. This proposal was referred to the Development Committee at that time. The Committee met on June 9, 1988, with the developer and staff to consider the project. Mr. Moreland again orally presented his concept and discussed various aspects of the project in detail. The Committee, working with Mr. Moreland and staff, attempted to establish a conceptual agreement that would provide the basis for an Exclusive Right to Negotiate as requested by the developer. 172 Bakersfield, California, June 20, 1988 - Page 4 The Committee and Mr. Moreland were unable to reach an agreement on terms since the developer was unwilling to comply with the normal requirements of an Exclusive Right to Negotiate and, therefore, the developer has withdrawn the project from further consideration at this time. Agency Member Rubin recognized Mr. Terry Moreland to speak. and work wants to Terry Moreland stated that they are willing to sit down out whatever can be done to satisfy the City if the City go forward with the magnitude of this project. Assistant City Manager Pulskamp stated he did not participate in the negotiations, Attorneys for the City and Mr. Moreland negotiated. The Development Committee provided staff with certain parameters to negotiate. The City made an offer of a one-year Exclusive Right to Negotiate and a $100,000 deposit. According to City Attorney Daniel, Mr. Wegis said he would withdraw their proposal and that he was not interested in further negotiations. Upon a motion by Agency Member Rubin, the Development Committee will meet with Developer Terry Moreland for further discussion on his proposal. Agency Member Dunn, read Design Review Committee Report No. 88-38 regarding an application by Alan's - Kern Jewelry and Loan for signage of a building located at 1207 through 1217 19th Street as follows: On June 9, 1988, the Design Review Committee met to review the application by Alan's - Kern Jewelry and Loan for signage of a building located at 1207 through 1217 19th Street. The Committee approved multiple signs for the shops located in a building at 1207 through 1217 19th Street. The Committee recommends that the Agency also approve the signage application. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-38 was accepted and recommendations implemented. Bakersfield, California, June 20, 1988 - Page 5 173 Agency Member Dunn read Design Review Committee Report No. 88-39 regarding an application by Ray Yinger for signage at a building located at 1600 "F" Street as follows: The Design Review Committee on June 9, 1988, reviewed the application by Ray Yinger for signage at his building located at 1600 "F" Street. The Committee approves a new sign of equal width to be placed above the existing sign. Sign should be equally spaced above the horizontal joint lines as existing sign is below. It is recommended by the Committee that the Agency approve the sign application as previously described. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-39 was accepted and recommendations implemented. Agency Member Dunn read Design Review Committee Report No. 88-40 regarding an application by Lambourne Travel for new canopy at a building located at 1230 17th Street as follows: The Design Review Committee, on June 9, 1988, formally reviewed and approved the application by Lambourne Travel (Jim Woltz) for installation of a new canopy, blue canvas, to be installed over a metal ribbed frame at their building located at 1230 17th Street. The Committee recommends that the Agency also approve this canopy application. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-40 was accepted and recommendations implemented. Agency Member Killmer made a motion to request that the Design Review Committee prepare some standards that the Agency can adopt regarding signage and canopys and other things that would fall in the guidelines of what is legal and appropriate for the development district. The motion was approved. Chairperson Watson requested that the issue of guide- lines for the Design Review Committee regarding approval of signage and canopys be placed on the agenda. NEW BUSINESS Agreement No. RA88-13, Indemnity Agreement with City Center Partners/Mosesian Development Corporation. Upon a motion by Agency Member Killmer, Agreement No. RA88-13 was approved and the Executive Director authorized to execute the agreement. 174 Bakersfield, California, June 20, 1988 Page 6 BILLS AND CORRESPONDENCE Deputy City Attorney Slocumb requested that the Agency go into Closed Session pursuant to Government Code Section 54596.9 to discuss the billings of pending litigation. Upon a motion by Agency Member Killmer all Warrants except those from Adams, Duque and Hazeltine were approved by the following vote: Ayes: Noes: Absent: Agency Members Araujo, Watson None Agency Member Paynter Dunn, Killmer, Kronenberg, Rubin, Assistant City Manager Pulskamp stated that the Manager's Office will contact each Agency Member to set a time for a tour of the Civic Auditorium to view the work that has been completed. AGENCY STATEMENTS Agency Member Araujo requested that prioritization of projects and the form of presenting the Budget be placed on the next agenda. Agency Member Dunn requested that the Agency and Staff explore the possibility of establishing a systematic process for on-going communication with the City Council and that this item be placed on the next agenda for discussion. Agency Member Kronenberg requested that staff provide the Agency with its potential exposures regarding its negotia- tions with Terry Moreland, if the Agency deviates from what is traditionally done under the exclusive right to negotiate standards. CLOSED SESSION Chairperson Watson recessed the meeting to Closed Session at 4:00 p.m. pursuant to Government Code Section 54596.9 regarding Pending Litigation. The meeting reconvened at 4:25 p.m. Chairperson Watson stated that no action was taken in the Closed Session. Upon a motion by Agency Killmer, all warrants from Adams, Duque & Hazeltine were approved by the following vote: Ayes: Noes: Absent: Agency Members Araujo, Watson None Agency Member Paynter Dunn, Killmer, Kronenberg, Rubin Bakersfield, California, June 20, 1988 - Page 7 I75 AGENCY STATEMENTS Agency Member Rubin spoke regarding the memorandum from City Attorney Saalfield regarding malpractice of the Moreland lawsuit. He stated if there was a lack of due diligence or pro- fessionalism from the law firm representing the Agency, he feels that the City should proceed with the malpractice lawsuit even though the chances of winning are less than 50 percent.
