HomeMy WebLinkAbout07/05/88 MINUTES RA176 Bakersfield, California, July 5, 1988 Minutes of the Regular Meeting of the Central District Development Agency of the City of Bakersfield, California, held in the Council Chambers of City Hall, 1501 Truxtun Avenue, at 3:00 p.m., July 5, 1988. The meeting was called to order by Chairperson Watson. City Clerk Williams called the roll as follows: Present: Agency Members Killmer, Kronenberg, Paynter, Rubin, Watson, Araujo, Dunn Absent: None MINUTES Upon a motion by Agency Member Rubin, Minutes of Regular Meeting of June 20, 1988, were approved. the PUBLIC STATEMENTS Ron Scharp, 1414 - 18th Street, spoke regarding the Community First Bank Project and posed the following questions: 1. What part in this project does the Redevelopment Agency play? 2. What legal powers can be invoked by the Agency if property owners cannot come to terms with the developer? 3. Does the Redevelopment Agency have the funds to relocate, reimburse for business loss, and assist tenants in relocations? (This issue was further discussed under Agency Statements on Page 6) Gerald B. Clifford, 1830 Truxtun Avenue, stated that he has no objections to any type of development in the downtown area, and is supportive of Greg Bynum's Project with Community First Bank. Angus D. Crites spoke in support of Greg Bynum's Project with Community First Bank. BILLS AND CORRESPONDENCE Upon a motion by Agency Member Kronenberg, Warrant Nos. 452 to 471 inclusive, in the amount of $180,951.22 were approved by the following vote: Ayes: Noes: Absent: Agency Members Araujo, Dunn, Killmer, Kronenberg, Paynter, Rubin, Watson, None None Upon a motion by Agency Member Rubin, communication received from Billie D. Smith, Northern California and Northern Nevada Pipe Trades Council, dated June 21, 1988, requesting the Agency adopt a resolution establishing a Prevailing Wage Requirement was received and referred to the Relocation and Public Relations Committee. Bakersfield, California, July 5, 1988 - Page 2 177 REPORTS Agency Member Killmer, Chairperson of the Development Committee, read Report No. 88-15 regarding formalization of guidelines for developers submitting projects for consideration as follows: The Development Committee met on June 23 to discuss the formalization of guidelines for the submission of projects, by developers, for consideration by the Central District Development Agency. The Agency had guide- lines which were historically included in Requests for Proposals (RFP's) and the purpose of the discussion was a review of these guidelines for recommendation to the Agency. After considerable discussion, guidelines, by category, were established which will provide developers a clear indication of the submission requirements in order to initiate review of a proposed project by the Agency. The adoption of the guidelines will insure fair and equitable treatment for all developers submitting projects to the Agency. Upon a motion by Agency Member Killmer, Development Committee Report No. 88-15 was accepted and the Guidelines were approved with the amendment by deleting the word "recent" in the third paragraph of the Developer Summary Guidelines. Agency Member Killmer, Chairperson of the Development Committee, read Report No. 88-16 regarding the guidelines for review of proposed projects by the Central District Development Agency as follows: The Development Committee met on June 23 to discuss establishing guidelines for review of proposals for development submitted to them. Such guidelines are the logical outgrowth of the formalization of guidelines for submission of projects by developers. The purposes of the guidelines are to guarantee developers fair and equitable treatment when the Central District Development Agency reviews a proposed project, and also an insurance that all possible aspects of a project are reviewed to protect the public resources which the Agency allocates. After thorough review of all available information on review techniques, the guidelines were determined to be relevant and significant. It is recommended that these guidelines be adopted by the Agency as presented. 178 Bakersfield, California, July 5, 1988 Page 3 Agency Member Kronenberg suggested that the Development Committee set up a "procedure" to bring back a report to the Agency indicating that projects meet the guidelines and, there- fore, the Agency can formally accept and file that report. Upon a motion by Agency Member Killmer, Development Committee Report No. 88-16 was accepted and the recommendations were implemented. Agency Member Killmer, Chairperson of the Development Committee, read Report No. 88-17 regarding the criteria for open- ing and closing a "window" as follows: The Development Committee met on June 23 to discuss establishing criteria for dealing with proposed redevelopment projects which may negatively impact upon a similar project where the Agency is a participant. Because the Central District Development Agency has limited resources, it is in the Agency's best interests that each project in which we participate has the highest chance of succeeding. These criteria were developed to manage the Agency's development funds wisely, as well as to provide assurance to all developers about the Agency's commitment to each project in which it is involved. After thorough review of all available information on review techniques, the criteria were determined to be relevant and significant. It is recommended that these guidelines be adopted by the Agency as presented. Agency Member Kronenberg suggested that if the Agency finds a "substantive negative impact" the Agency should formally make a "finding after review" and accept and file that kind of report. He also suggested that the wording be changed in the criteria. Deputy City Attorney stated that the policy should be clear. Upon a motion by Agency Member Rubin, Development Committee Report No. 88-17 was referred back to the Development Committee. Bakersfield, California, July 5, 1988 - Page 4 179 Agency Member Dunn, read Design Review Committee Report No. 88-41 regarding transferring the temporary advertising (signs, banners, and balloons) permit process to the City Building Division as follows: On June 23, 1988, the Design Review Committee discussed the issue of Temporary Advertising Signs, Banners, and Balloons. In the past, prior to the establishment of the Central District Development Agency (CDDA) and the Design Review Committee, the City Building Division processed all Temporary Sign Permits. However, with the creation of the new Agency, the matter has been the responsibility of the Committee. The current procedure is time consuming for both applicants and the Design Review Committee, as well as the Agency. In this regard, the Committee is recommending that the Agency approve the transferring of this process back to the City Building Division. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-41 was accepted and recommendations were implemented. Agency Member Kronenberg suggested that the Building Division provide the Agency with a yearly report regarding tem- porary sign permits. City Manager Hawley stated that staff would take care of that request. Agency Member Dunn, read Design Review Committee Report No. 88-42 regarding application submitted by Danny Lipco for tem- porary signage (balloon) for Emporium Western Store at 1031 19th Street as follows: On June 23, 1988, the Design Review Committee reviewed an application by Danny Lipco for temporary signage (blue jean balloon) for the Emporium Western Store located at 1031 19th Street. The Committee approved the application as submitted and recommends that the Agency do likewise. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-42 was accepted and the recommendations were implemented. 180 Bakersfield, California, July 5, 1988 - Page 5 Agency Member Dunn, read Design Review Committee Report No. 88-43 regarding application submitted by Gottschalks for temporary banners for building located at 20th Street and Chester Avenue as follows: On June 23, 1988, the Design Review Committee reviewed the application by Gottschalks for signage (temporary banners) at a building located at 20th and Chester. The Committee approved the application for two banners 48' x 4' 3" to be placed on the 20th Street and Chester Avenue side for a period starting on July 1, 1988 through July 15, 1988. The Committee recommends that the Agency also approve this application. Upon a motion by Agency Member Dunn, Design Review Committee Report No. 88-43 was accepted and the recommendations were implemented. NEW BUSINESS Staff presentation regarding funding of Central District Development Agency. Assistant City Manager Pulskamp provided an oral report and reviewed the cash flow. Revision and clarification of budget format and presentation. Upon a motion by Agency Member Rubin, Revision and clarification of budget format and presentation was referred to the Development Committee for review and recommendation to the Agency. Prioritizing projects and activities of the Central District Development Agency for Fiscal Year 1988-89. Upon a motion by Agency Member Kronenberg, staff was directed to develop a list of projects in which the Agency has indicated interest, and present this list to the full Agency to be prioritized. AGENCY STATEMENTS On-going communications between the Central District Development Agency and the City Council. (Dunn) Agency Member Dunn stated that she would like to have communication between the Agency and the City Council on an on-going basis. Bakersfield, California, July 5, 1988 - Page 6 181 Assistant City Manager Pulskamp suggested the following alternatives to the Agency to improve communications with the Council: 1. A committee from the Agency meet with a committee from the Council on a regular basis. 2. The full bodies of the Agency and Council could meet. 3. Direct staff to update Council regarding the Agency. 4. Place items on the Council Agenda. 5. Agency Members could be placed on the Council Agenda to speak. 6. Workshops. Assistant City Manager Pulskamp suggested that a commit- tee meeting could be most effective, where each committee would report back to the full bodies. The Agency is very interested in meeting with the Council and directed staff to ask the Council how they would to meet with the Agency. like The Agency expressed their appreciation for the work done by Assistant City Manager Pulskamp and wished him well in his new endeavors. Staff will be contacting Ron Scharp to answer his questions presented during Public Statements regarding the Community First Bank Project.
