BAKERSFIELD REDEVELOPMENT AGENCY
Special Meeting---April 16, 1982
The Special Meeting of the Bakersfield Redevelopment Agency was called
to order by Mr. Mooneyham on Friday, April 16, 1982, at 4:01 p.m. in the
City Council Chamber. The secretary called the roll as follows:

RETAIL SHOPPING CENTER
Correspondence was received from John S. Griffith and Company requesting
the return of a $500,000 good faith deposit submitted to the Redevelopment
Agency for the construction of the Proposed Retail Shopping Center.
Other correspondence received were: a letter from the Bank of Nova
Scotia stating that funds are available for the project; a letter from J. C.
Penney indicating that they pulled out of the project because May Co. pulled
out; and a letter form May Company stating that they were not interested in
further development of the downtown shopping center.
Mr. Oberholzer stated that on January 26, 1982, a resolution was implemented
and stated that the Redevelopment Agency shall retain the $500,000 deposit
unless and until developer provides evidence that it can obtain sufficient
financing to develop the property, which is the subject of the Joint Development
Agreement, or other evidence justifying the return of the $500,000 deposit.
Mr. Oberholzer further stated that from the legal standpoint, based upon
evidence that has been submitted by John S. Griffith and Co., that it would
be appropriate for the Redevelopment Agency to authorize the return of the
$500,000 good faith deposit and that the Agency keep the interest that has
been accrued.
Mr. Lewis questioned whether the letters are sufficient evidence of
what actually took place. Mr. Oberholzer stated that the letters are sufficient
evidence and that pursuant to the Implementation Agreement entered into on
June 11, 1981, it is legally proper to return the deposit to Griffith and
Company.
Mr. Winer made a motion to return the $500,000 deposit to John S. Griffith
and Company, which was submitted to the Agency as a good faith deposit for
the construction of the Proposed Retail Shopping Center. Mr. Moore seconded
the motion which was approved by the following roll call vote:
