HomeMy WebLinkAboutRES NO 107-95RESOLVTION NO. 1 0 7 "9 ,5 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADOPTING DRAINAGE PLAN FOR THE AKERS/MCKEE PLANNED DRAINAGE AREA AND MAKING FINDINGS RELATIVE THERETO. WHEREAS, pursuant to Section 66483 of the California Government Code, this Council is, upon the making of specific findings, authorized to adopt drainage plans for local and neighborhood drainage areas, and; WHEREAS, the Council approved Ordinance No. 3417 which amended Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Bakersfield Municipal Code and City Zoning Map No. 123-35 on the 20th day of November, 1991, and; WHEREAS, the Conditions of Approval for Ordinance No. 3417 required the developer to initiate formation of a Planned Drainage Area for the zone change area if needed to facilitate construction of the drainage system. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct. 2. Subdivision and development of property within the Akers/McKee Planned Drainage Area, as shown on the map attached hereto and incorporated herein by reference as Exhibit "A", will require construction of facilities described in the Akers/McKee Drainage Plan, attached hereto and incorporated herein by reference as Exhibit 3. The fees mandated by such Drainage Plan are fairly apportioned within such Planned Drainage Area on the basis of benefits conferred on property proposed for subdivision and on the need for such facilities created by the proposed subdivision and development of other property within such area. 4. The Akers/McKee Planned Drainage Area is hereby adopted.
