HomeMy WebLinkAbout08/12/80 MINUTES RA M I NU TE S BAKERSFIELD REDEVELOPMENT AGENCY Special Meeting-August 12, 1980 A Special Meeting of the Bakersfield Redevelopment Agency was called to order by Vice Chairman Foth Tuesday, August 12, at 4 p.m. in the City Council Chamber. The secretary called the roll as follows: MEMBERS PRESENT: STAFF PRESENT: OTHERS PRESENT: Jeanne Foth, Vice Chairman Robert E. King Frank S. Lewis John S, Mooneyham ABSENT: Vincent Casper, Chairman Dr. Glenn D. Puder Gene Winer Melvin A. Tooker, Development Services Coordinator Richard Oberholzer, Assistant City Attorney Mr. William C. Kuhs (Attorney), Bell Tower Associates ITEM 1: CONSIDER REQUEST FROM BELL TOWER ASSOCIATES RE ACQUISITION OF LOT 1, BLOCK 288: Vice Chairman Foth noted that this request from Bell Tower Associates was on the Agenda of the Agency's meeting July 22, 1980, but could not be con- sidered because of the abstention of one member, thereby leaving the Agency without a quorum to act. Vice Chairman Foth reviewed Bell Tower Associates' (BTA) letter of July 14, 1980 requesting "...that the Redevelopment Agency give consideration to the acquisition of Lot 1, Block 288 by eminent domain for resale to BTA to allow for the orderly development of Old Church Plaza." Mr. Tooker noted that BTA's first request for the Agency's assistance in obtaining this property was dated April 19, 1979, at which time Mr. Kuhs reported they were unable to negotiate the acquisition due to inability to contact (after numerous attempts) the owner, Mr. Gilbert Burns. Agency staff made written and verbal attempts at that time to help get the parties together to negotiate, but took action on September 26, 1979, ",..to discontinue expen- ding funds in an attempt to help resolve the dispute between Bell Tower Associates and Mr. Burns regarding Mr. Burns' property." The consensus of Agency members was that use of the power of eminent domain in this case would be inappro- priate. BTA~s letter of July 14, 1980 apprised the Agency of an agreement between BTA and Mr, Burns for the purchase of the property by BTA for $225,000; however, litigation against Mr. Burns is holding up the sale, thereby delaying progress on BTA~s Old Church Plaza project, Mr, Kuhs reviewed his proposal, as stated in his letter of July 14, that the Agency acquire the property by eminent domain, sell to BTA for the amount and terms of the agreement with Mr. Burns, and then disburse the proceeds per order of the Superior Court (Case No. 164325), Mr. Kuhs stated that Mr. Burns has no objection to this procedure. Following discussion, Mr. King moved that the Agency instruct the City Attorney's office to prepare the necessary agreements for acquisition of the property~ subject to all expenses being borne by BTA, including staff pay. The motion was seconded by Mr, Lewis, and carried. ADJOURNMENT There being no further business to come before the Agency, Vice Chairman Foth adjourned the meeting at 4:25 p.m. Bernice E.
