A RESOLUTION OF THE CITY OF
BAKERSFIELD SUPPORTING RENEWAL
OF THE RECYCLING MARKET
DEVELOPMENT ZONE NO. 26 PROGRAM
(Year 2004 to 2014)
WHEREAS, California Public Resources Code Section 42010 provides for the
establishment of the Recycling Market Development Zone (RMDZ) Program throughout
the State of California to provide incentives to stimulate development of post-consumer
and secondary materials markets for recyclables; and
WHEREAS, the RMDZ No. 26 Program includes Kern County, the cities of Arvin,
Bakersfield, Delano, California City, Maricopa, McFarland, Ridgecrest, Shafter, Taft,
Tehachapi, Wasco and the City of Lancaster in Los Angeles County; and
WHEREAS, cities and counties must meet a fifty percent reduction in landfill
waste disposal as mandated in the California Integrated Waste Management Act; and
WHEREAS, the RMDZ No. 26 Program is dedicated to establishing, sustaining
and expanding recycling-based manufacturing businesses, which is essential for market
development and to assist local jurisdictions in meeting the established landfill reduction
goals; and
WHEREAS, the RMDZ No. 26 Program designation will expire on March 30,
2004 unless re-designated by the California Integrated Waste Management Board
(CIWMB); and
WHEREAS, the County of Kern, the 11 incorporated cities in Kern County and
the City of Lancaster still desire existing and new recycling-based manufacturing
businesses locating within the region to be eligible for the technical and financial
incentives associated with the RMDZ Program; and
WHEREAS, the renewal of the RMDZ No. 26 Program is still necessary to
facilitate local and regional planning, coordination, support of existing recycling-based
manufacturing businesses, as well as to attract private sector recycling business
investments to the region; and
WHEREAS, the current and proposed waste management practices and
conditions are favorable to the development of post-consumer and secondary waste
materials markets; and

WHEREAS, the California Legislature has defined environmental justice as "the
fair treatment of people of all races, cultures and incomes with respect to the
development, adoption, implementation, and enforcement of environmental laws,
regulations, and policies: [Government Code section 65040.12(e)], and has directed the
California Environmental Protection Agency to conduct its programs, policies, and
activities that substantially affect human health or the environment in a manner that
ensures the fair treatment of people of all races, cultures, and income levels, including
minority populations and Iow-income populations of the state [Public Resoumes Code
section 71110(a)]; and
WHEREAS, the CIWMB, in its Strategic Plan, has adopted a goal to continuously
integrate environmental justice concerns into all of the Board's programs and activities;
and
WHEREAS, the County of Kern has prepared or caused to be prepared a
Negative Declaration pursuant to the California Environmental Quality Act and on the
basis of the whole record before it found that the zone renewal program will not have a
significant effect on the environment and further found that the Negative Declaration
reflected its independent judgment and analysis; and
WHEREAS, the record of the proceedings on which the County of Kern based its
decision to adopt the Negative Declaration was and is available from the Kern County
Waste Management Department (KCWMD) located at 2700 "M" Street, Suite 500,
Bakersfield California; and
WHEREAS, the City of Bakersfield has reviewed and considered the information
in that Negative Declaration and concurs that the zone renewal program will not have a
significant impact on the environment..
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:

incomes, including, but not limited to, soliciting public participation in all communities
within the RMDZ No. 26 Program.
