A RESOLUTION DISPENSING WITH BIDDING PROCEDURES
DUE TO EMERGENCY REPAIRS RESULTING FROM
COLLAPSED UNDERGROUND CULVERT AT 19TM STREET,
WEST OF OAK STREET, NOT TO EXCEED $2,000,000 (INITIAL ESTIMATE ONLY)

WHEREAS, on Thursday, October 30, 2003, a large s~nk hole was detected on 19
Street, west of Oak Street; and
WHEREAS, City crews were immediately dispatched to the area and discovered the 12
foot wide corrugated culvert metal pipe, which is a part of the Carrier Canal, was rested/corroded
and had collapsed; and
WHEREAS, four vehicles had fallen into this sink hole, and the southeast comer of a
private business parking lot also required emergency repairs created by the collapsed metal canal
culvert pipe; and
WHEREAS, on Thursday, October 30, 2003, the Public Works Director was informed
that the repairs could not be fixed by City staff alone; and
WHEREAS, the Public Works Director declared this problem an emergency and the
work to be performed was of urgent necessity for the preservation of life, health or property; and
WHEREAS, the Public Works Director determined the area of 19th Street, west of Oak
Street, and Oak Street from Tmxtun Avenue to 21 st Street had to be closed for emergency
repairs caused by the collapsed metal pipe. Portions of Oak Street are still closed with only one
lane in each direction available for travel, with left hand turns prohibited. Repairs are ongoing
and are anticipated to take a month to complete; and
WHEREAS, the nature of repairs and the potential liability to the City, required the use
of outside forces to repair the collapsed pipe and remove the lodged vehicles in a timely manner;
and
WHEREAS, to remedy this emergency, the Public Works Director authorized
construction services on a time-and-materials basis to remove the existing corrugated pipes and
construct a cast-in-place reinforced concrete box culvert to replace the section that collapsed.
The Public Works Director also authorized crane service to remove the four vehicles had fallen
into the sinkhole.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are tree and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals the work
performed was of urgent necessity for the preservation of life, health or property, thereby

allowing the dispensing of bidding requirements as set forth in Section 136 of the City
Charter and Section 3~20.060 of the Bakersfield Municipal Code.
3. The Finance Director is authorized to dispense with bidding in accordance with
Section 3.20.060 of the Bakersfield Municipal Code.
