A RESOLUTION DETERMINING THAT THE OPERATING
SOFTWARE FOR THE MOBILE DATA TERMINAL SYSTEM
CAN BE REASONABLY OBTAINED FROM ONLY ONE
VENDOR, TIBURON, INC., AND AUTHORIZING THE
FINANCIAL DIRECTOR TO DISPENSE WITH BIDDING
THEREOF; APPROVAL OF AGREEMENT TO PURCHASE
MOBILE DATA TERMINAL OPERATING SOFTWARE.
WHEREAS, the Bakersfield Police Department is currently
upgrading its communications, dispatch and records systems; and
WHEREAS, the Council approved $1,700,000.00 ($1,400,000.00
seized asset forfeiture and $300,000.00 capital outlay funds) to
purchase and install the mobile data terminal system necessary to
complete the upgrade process; and
WHEREAS, Tiburon, Inc., the Bakersfield Police Department's
computer automated dispatching and records management software
vendor will develop and install the necessary software to interface
all systems and make the mobile data terminals operable; and
WHEREAS, only Tiburon software is compatible with the mobile
data terminals and meets all specifications for operation; and
WHEREAS, the Finance Director has determined, and has
recommended the Council find, the operating software for the mobile
data terminal system can only be reasonably obtained from one
vendor, Tiburon, Inc., and recommends dispensing with bidding
therefor in accordance with subsection D.1. of Section 3.20.060 of
the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above-recitals are true and correct and incorporated
herein by reference.
2. Said operating software for the mobile data terminal
system can only be reasonably obtained from one vendor because of
the need to successfully integrate the software into an existing
City project and system.
3. The Finance Director is authorized to dispense with
bidding and to negotiate the purchase of same, not to exceed
$98,000.00.
4. The Mayor is authorized to execute a contract, as
approved by City staff, with Tiburon, Inc.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular
