A RESOLUTION DETERMINING THAT DESIGN AND
INSTALLATION OF A LANDFILL GAS MANAGEMENT
SYSTEM AT THE BAKERSFIELD LANDFILL CANNOT BE
REASONABLY OBTAINED THROUGH USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE
DIRECTOR TO DISPENSE WITH BIDDING THEREFOR,
NOT TO EXCEED $800,000; AND APPROPRIATION OF
FUNDS.
WHEREAS, City has previously installed a gas collection system at the
Bakersfield Landfill and said system has proved inadequate; and
WHEREAS, it is necessary immediate steps be taken to control landfill gas;
and
WHEREAS, City has been issued an order from Kern County Environmental
Health to take steps to control the migration of landfill gas; and
WHEREAS, City desires to control the migration of landfill gas through a
landfill gas management system which can be integrated with future final capping and
environmental closure of the landfill; and
WHEREAS, City has employed Kleinfelder Company to design and instull a
landfill gas management system using a phased approach; and
WHEREAS, Kleinfelder Company has performed the first two elements of said
project as agreed; and
WHEREAS, research and evaluation of data obtained in Elements One and
Two of said project indicate the most appropriate course of action in Element Three; and
WHEREAS, the most appropriate course of action in Element Three is to
replace the landfill gas management system previously installed by others; and
WHEREAS, Kleinfelder Company has designed a new system to replace said
system with one which will be integrated with future final capping and environmental
closure of the landfill; and
WHEREAS, City desires Kleinfelder Company to construct the new system
under additional work scope of the existing Agreement; and
WHEREAS, Kleinfelder Company represents that they are experienced
well qualified in the field of landfill gas control; and

WHEREAS, the Finance Director recommends the Council find said project's
work, supplies, equipment and materials cannot be reasonably obtained from more than one
vendor as per the Public Works Director recommendation and recommends the Council
dispense with bidding under subsection D. 1. of Section 3.20.060 of the Bakersfield Municipal
Code.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The above-recitals are true and correct and incorporated herein by
reference.
2. The work, supplies, equipment and materials cannot be reasonably
obtained from more than one vendor because of the need to successfully integrate the work,
supplies, equipment and materials into an existing City project and system.
3. The Finance Director is authorized to dispense with bidding in
accordance with subsection D.1. of Section 3.20.060 of the Bakersfield Municipal Code.
4. The appropriation of $500,000 Self-Insurance Fund Balance to the Public
Works Capital Improvement Budget in the Refuse Fund for construction of a landfill gas
management system is approved.
5. The Mayor is authorized to executed a contract amendment, as
approved by the City staff, with Kleinfelder Company.
6. The expenditure of funds for said work, supplies, equipment and
materials involved with said contract shall not exceed $800,000.
