RESOL~ION APPROVING ~ENDED BOlDlY ~P (~ENDMENT NO. 1)
CITY OF BAKERSFIELD
ASSESSMENT DISTRICT NO. 94-3
(SILVER CREEK/BRIM/~ALL NORTH/SEVEN OAKS/SOUTH LAURELGLEN)
WHEREAS, by its Resolution No. 199-94, entitled
"Resolution Approving Boundary Map", adopted on December 14,
1994, this City Council previously approved an informal boundary
map for this proposed assessment district, which informal map, as
filed with the City Clerk of the City, consisted of three exhibit
maps as more fully identified in said Resolution No. 199-94; and
W~EREAS, in Section 2 of said Resolution No. 199-94,
this city Council directed Wilson & Associates, as assessment
engineers for this proposed assessment district, to prepare a
formal boundary map on the basis of said informal boundary map;
and
WHEREAS, several modifications of said previously-
approved boundary have become appropriate in view of the addition
of property to the proposed assessment district, refinements to
parcel configurations, and/or transfers in ownership of portions
of the subject property which warrant deletions of portions of
the previously-included property; and
WHEREAS, in view of the substantiality of changes to
the previously-approved informal boundary map, Wilson &
Associates, assessment engineers for this proposed assessment
district, have prepared and filed with the City Clerk of the City
an amended boundary map entitled "Amendment to Proposed
Boundaries of city of Bakersfield Assessment District No. 94-3
(Silver Creek/Brimhall North/Seven Oaks/South
Laurelglen)(Amendment No. 1), County of Kern, State of
California" for consideration by this City Council;
NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS,
DETERMINES AND RESOLVES as follows:
1. This Council finds and determines that the proposed
Amendment to Proposed Boundaries of City of Bakersfield
Assessment District No. 94-3 (Amendment No. 1) is in the form and
contains the matters prescribed by Section 3110 of the California
Streets and Highways Code.
2. This Council approves said map and adopts the
boundaries shown on said map as describing the extent of the
territory specially benefitted by the proposed improvements and
therefore to be included in this proposed assessment district, to
be known as "City of Bakersfield Assessment District No. 94-3
(Silver Creek/Brimhall North/Seven Oaks/South Laurelglen)".
3. This Council directs the City Clerk to certify the
adoption of this resolution on the face of said map, and to file
a copy of the map with the Kern County Recorder for placement in
the Book of Maps of Assessment and Community Facilities
Districts.
I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on August 9, 1995, by the following
vote:
