RESOLUTION DETERMINING THAT A USED COMPOST TURNER CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH FORMAL BIDDING THEREFORE. WHEREAS, The City of Bakersfield Public Works Department is in need of one (1) used compost turner for use at the City's Woodwaste Facility; and WHEREAS, The City of Bakersfield is presently leasing a compost turner (Scarab) from San Joaquin Cornposting under terms which allow purchase of the unit for $45,000.00 in excess of all lease payments made to date. WHEREAS, The purchase of a new similar unit would cost an estimated $175,000 which exceeds the figure approved for purchase of $80,000.00. WHEREAS, This unit can only be reasonably obtained from one vendor due to restricted availability of this used equipment at the price offered under the lease agreement. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and incorporated herein by reference. The one (1) used compost turner for the City of Bakersfield Woodwaste facility can only be reasonably obtained from one vendor (San Joaquin Composting), because of the unique lease/purchase agreement involved with this equipment. The Finance Director is authorized to dispense with bidding and to enter into a contract for the purchase of same, not to exceed forth-five thousand dollars ($45,000.00).
