HomeMy WebLinkAboutRES NO 124-95RESOLUTION NO. 124-95 A RESOLUTION PROVIDING FOR THE COLLECTION OF REFUSE CHARGES BY THE KERN COUNTY TAX COLLECTOR. WHEREAS, on July 2, 1986, the City Council of the City of Bakersfield duly passed and adopted Ordinance No. 3052 requiring the recovery of costs reasonably borne from fees and charges levied therefore in providing the regulation, products, or services enumerated in this ordinance for the collection and disposal of refuse; and WHEREAS, on April 24, 1991, the City Council duly passed and adopted Ordinance No. 3359 amending Chapter 3.70 of the Bakersfield Municipal Code regarding the procedure for revising and/or adding said fees and charges; and WHEREAS, on April 19, 1995, the City Council passed and adopted Resolution No. 69-95, adopting fees and service charges pursuant to the revenue/cost comparison system; and WHEREAS, Section 50 of the Charter of the City of Bakersfield and Section 51334 of the Government Code of the State of California permit the City Council to provide for the collection of such charges by the County Tax Collector; and WHEREAS, Section 8.32.060 B. of the Bakersfield Municipal Code requires that such refuse charges be submitted to the Kern County Auditor-Controller and Tax Collector for placement of such charges as assessments on the secured roll of the County to be collected in the same manner as ad valorem property taxes. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The Council of the City of Bakersfield transfers the function of collection of refuse charges for all single-family dwellings, duplexes, triplexes and fourplexes to the Kern County Tax Collector pursuant to Section 8.32.060 B. of the Bakersfield Municipal Code to be billed at the time of billing of property taxes. The fees and charges set forth in Exhibit A concerning service charges under Chapter 3.70 of the Bakersfield Municipal Code are hereby adopted and shall become effective on May 1, 1995, except for development fees which shall become effective on July 1, 1995. ooo ..........
