A RESOLUTION ORDERING THE VACATION OF THE 33 FOOT WIDE ALLEY (17th PLACE) IN BLOCK 275 FROM "H" STREET TO EYE STREET. WHEREAS, on WEDNESDAY, JUNE 28, 1995, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1137 declaring its intention to order the vacation of the 33 foot wide alley (17th Place) in Block 275 from "H" Street to Eye Street in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that the alley vacation and proposed use as a private driveway could have a significant effect on the environment; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, July 19, 1995, after notices were duly published and posted as required by law. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The 33 foot wide alley (17th Place) is in Block 275 from "H" Street to Eye Street in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: All of the 33 foot wide alley in Block 275 as said block and alley right of way are shown on "Map of the City Bakersfield", filed for record November 25, 1898 in the office of the Kern County recorder, said alley area being bounded by the east right of way line of "H" Street and the west right of way of Eye Street. 3. Said alley is unnecessary for present or prospective public use or alley purposes and is hereby vacated, subject to the conditions enumerated herein. 4. A non-exclusive easement shall be reserved for public utilities purposes and City sewer main purposes in, under, over and upon the entire above described alley area. 5. An easement shall be reserved by the City of Bakersfield for emergency fire protection access over a 20 foot wide strip lying 10 feet on each side of the center line of the above described alley area. 6. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. ...... 00o ......
