HomeMy WebLinkAboutRES NO 140-95RESOLVTION NO. 1 4 0 - 9 5 A RESOLUTION MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND ADOPTING SEGMENT VII OF PROPOSED AMENDMENT TO THE CIRCULATION ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (CIRCULATION ELEMENT AMENDMENT 2-95). WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on MONDAY, June 12, 1995, and THURSDAY, June 15, 1995, on Segment VII of a proposed amendment to the Circulation Element of the General Plan, notice of the time and place of hearing having been given at least twenty-one (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment VII of the proposed amendment to the Circulation Element of Metropolitan Bakersfield 2010 General Plan is as follows: SEGMENT VII: The City of Bakersfield has applied to amend the Circulation Element of the Metropolitan Bakersfield 2010 General Plan, incorporating the Western Rosedale Specific Plan Multi-Use Trail and Equestrian Trail System and a cross-sectional improvement standard for a multi-use trail along collector streets; and WHEREAS, for the above-described Segment, CEQA does not apply to the proposed project since amending the City's Circulation Element Map to incorporate the multi-use trail system within the Western Rosedale Specific Plan as previously adopted by the County of Kern does not have any potential to cause significant adverse environmental impacts, and a Notice of Exemption pursuant to Section 15061(b)(3) - General Rule of the CEQA Guidelines has been completed; and WHEREAS, the law and regulations relating to the preparation of a Notice of Exemption as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by the city staff and the Planning Commission; and WHEREAS, by Resolution No. 50-95 on June 15, 1995, the Planning Commission recommended approval and adoption of Segment VII and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, AUGUST 30, 1995, on the above described Segment VII of the proposed amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, the Council has considered and hereby makes the following findings: 1. All required public notices have been given. 2. The project is exempt from CEQA pursuant to Section 15061 (b)(3) of the CEQA Guidelines (General Rule). 3. Approval of the amendment will recognize the County's prior adoption of the multi-use and equestrian trails system in the Western Rosedale area. 4. Approval of the amendment will allow for future extensions of the existing recreational trails network as land areas within the Western Rosedale community are annexed in the future. 5. Adoption of the multi-use and equestrian trail systems in Western Rosedale is consistent with the goals, policies and standards of the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The project is exempt from CEQA pursuant to Section 15061(b)(3) - General Rule of the CEQA Guidelines. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment VII of the proposed amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan, constituting changes as shown on the map marked Exhibit "B" and trail improvement standard labeled Exhibit "C," attached hereto and incorporated as though fully set forth, for property generally located south of Seventh Standard Road, west of Jewetta Avenue, east of Enos Lane, and north of the Kern River. 2 5. That Segment VII, approved herein, be combined with other approved segments described in separate resolutions, to form a single Circulation Element Amendment, GPA 2-95. ......... 000 ........
