RESOLUTION NO.
A RESOLUTION DISPENSING WITH BIDDING PROCEDURES
DUE TO EMERGENCY REPAIRS REQUIRED AT THE FOUR CARRIER CANAL
CROSSINGS, NOT TO EXCEED $1,700,000 (INITIAL ESTIMATE ONLY)
WHEREAS, at the November 5, 2003, Council meeting Resolution No. 199-03 was
approved which authorized the dispensing of bidding procedures due to emergency repairs
resulting from the collapsed underground culvert at 19th Street, West of Oak Street, not to exceed
$2,000,000 (initial estimate only); and
WHEREAS, as a result of the culvert failure at 19th and Oak Streets, the Public Works
Department immediately began an investigation into the condition of the four other Carrier Canal
crossings that are downstream of the collapsed area; and
WHEREAS, the attached "Report of Findings, Carder Canal Crossings of: Truxtun
Avenue near Pistol Range; Mohawk Street south of Truxtun Avenue; Truxtun Avenue east of
Quailridge Road; and City Corporation Yard Main Entrance" was prepared by and signed by
both the Public Works Director and Assistant Public Works Director, said report is included
herein by reference; and
WHEREAS, while the results of the investigation showed no indication that the four
canal crossings are in imminent danger of collapsing, the Public Works Director recommends
that the most prudent action would be to commence with repairs immediately since 1) the four
Carrier Canal Crossings are constructed with a metal plate arched culvert which is not the best
structure available; 2) this is the optimal time to disrupt water flow through the canal with no
damage to farmers' crops, as long as the repairs are completed by January, 2004.; and
WHEREAS, the Public Works Director recommends repairing these canal crossings by
using the in-situ technique which involves constructing a new reinfomed pipe within the existing
pipe, using high strength gunnite material. By utilizing the in-situ method of repair, them will be
no disruption to existing traffic flows; and
WHEREAS, repairs to the four canals will begin on November 10, 2003. All repairs
will be completed by January, 2004.; and
WHEREAS, the Public Works Director declared this problem an emergency and the
work to be performed was of urgent necessity for the preservation of life, health, or property; and
WHEREAS, due to the nature of the repairs and the potential liability to the City, arising
from damage to farmers' crops if repairs are not done in a timely manner and the need to repair
the canal crossings, the use of outside forces to repair the four canal crossings is necessary; and
WHEREAS, to remedy this emergency, the Public Works Director authorized
construction services on a time-and-materials basis to repair the four canal carrier crossings by
utilizing the in-situ technique.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are tree and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals the work
performed was of urgent necessity for the preservation of life, health or property, thereby
allowing the dispensing of bidding requirements as set forth in Section 136 of the City
Charter and Section 3.20.060 of the Bakersfield Municipal Code.
3. The Finance Director is authorized to dispense with bidding in accordance with
Section 3.20.060 of the Bakersfield Municipal Code.
