WHEREAS, on WEDNESDAY, AUGUST 30, 199~, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Slxeets, Highways and Senrice Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of IntoUion No. 1138 declaring its intention to order the vacation of the excess road right of way for Stockdale Highway between Old River Road and California State University Bakersfield in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that the road right of way vacation could have a significant effect on the environment; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on WEDNESDAY, SEPTEMBER 27, 199~, after notices were duly published and posted as required by law. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. The excess road right of way for Stockdale Highway between Old River Road and California State University Bakersfield in the City of Bakersfield, County of Kern, State of California, more particularly described in EXHIBIT "A", is unnecessary for present or prospective public use or road right of way purposes and is hereby vacated, subject to the conditions enumerated herein. 3. A nonexclusive easement shall be reserved for public utilities purposes in, under, over and upon the South 10 feet and the East 22.5 feet of the South 20 feet of the parcel herein described in EXHIBIT "A". Also reserving the 10 foot wide easement granted to Pacific Gas and Electric Company by document recorded in Book 5578, Page 754, Official Records in the Office of the Kern County Recorder. The City Clerk shall certify to the passage of this Resolution and shah cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California.
