A RESOLUTION OF THE CITY OF
BAKERSFIELD RELEASING LIEN
RECORDED ON REAL PROPERTY
LOCATED AT 630 KENTUCKY STREET
(APN 014-270-07)
WHEREAS, on August 8, 2001, pursuant to Resolution No. 115-01, the City of
Bakersfield ("City") authorized the creation of a code enforcement lien for $93,464.00 to
be recorded on 630 Kentucky Street ("the Property"); and
WHEREAS, on August 9, 2001, that lien was recorded as Instrument No.
0201114756 in the Kern County Recorder's Office; and
WHEREAS, the Property lies within the Old Town Kern-Pioneer Redevelopment
Project Area; and
WHEREAS, in November, 2003, the Bakersfield Redevelopment Agency
("Agency") purchased the Property for the full appraised value; and
WHEREAS, such amount is not enough to pay the lien in its entirety; and
WHEREAS, the lien has been placed on the real property tax roll for collection;
and
WHEREAS, the Agency intends to use the Property as part of a multi-million
dollar mixed-use redevelopment project ("the Project"); and
WHEREAS, the Project will consist of affordable housing, retail shops and an
open air plaza and will be sited on both sides of Baker Street between Kentucky and
Jackson Streets and Kern and King Streets; and
WHEREAS, it is the intent of the Agency to convey the Property to the developer
of the Project, thus, placing the Property on the tax rolls; and
WHEREAS, as the City's lien has not been paid, Agency has requested City to
release the lien at no cost to the Agency in order to effectuate the redevelopment of the
Property and the revitalization of the Baker Street corridor.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:

2. It is in the best interest of the City of Bakersfield to encourage
redevelopment of blighted areas.
3. The lien recorded on August 9, 2001, as Instrument No. 0201114756,
including any interest and penalties, is hereby released in its entirety.
4. The Finance Director shall prepare and record a lien release for the lien at
no charge to the Bakersfield Redevelopment Agency.
5. A certified copy of this Resolution shall be forwarded to the Kern County
Auditor/Controller's office to ensure release of the lien from the real property tax rolls.
