RESOLUTION CALLING THE PRIMARY MUNICIPAL
ELECTION FOR THE OFFICE OF MAYOR, AND SPECIAL
MUNICIPAL ELECTION FOR THE AMENDMENTS TO THE
CITY CHARTER, REQUESTING THE BOARD OF
SUPERVISORS OF THE COUNTY OF KERN TO OIlDER
CONSOLIDATION OF SAID ELECTIONS WITHTHE STATE
OF CALIFORNIA PRESIDENTIAL PRIMARY TO BE HELD
TUESDAY, I~ARCH 26, 1996, AND SETTING
PRIORITIES FOR FILING WRI'l-l'~,~ ARGUMENTS
REGARDING CiTY MEASIFRESANDDII~ECTINGTHE CITY
ATTORNEYTO PREPAREAN IMPARTIAL ANALYSIS.
WHEREAS, the State of California Presidential Primary will be
held on Tuesday, March 26, 1996; and
WHEREAS, pursuant to Section 67.1(a) of the Charter of the
City of Bakersfield, the Primary Municipal Election for the Office
of Mayor of the City of Bakersfield for the full term of four (4)
years shall be held concurrently with the State of California
Primary Election; and
WHEREAS, the Council proposes to submit amendments to the City
Charter in the manner set forth in Chapter 3, Division 2, of Title
4 (commencing with section 34450 of the Government Code of the
State of California), at a Special Municipal Election; and
WHEREAS, Section 10403 of the Elections Code of the State of
California provides that whenever an election called by a City for
the submission of any proposition or office to be filled is to be
consolidated with a statewide election, and such proposition or
office to be filled is to appear upon the same ballot as that
provided for such statewide election, the City shall, at least 88
days prior to the date of the election, file with the Board of
Supervisors, and a copy with the County Chief Deputy Registrar of
Voters, a resolution requesting such consolidation and setting
forth the exact form of any proposition or office to be voted upon
at such election, as the same are to appear on the ballot; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. That the PrLmary Municipal Election for the Office of
Mayor of the City of Bakersfield for the full term of four years is
hereby called and will be held on Tuesday, March 26, 1996;
2. That the Special Municipal Election is hereby called to be
held in the City of Bakersfield on Tuesday, March 26, 1996, for
submitting the following Charter amendments to the electors:
MEASURE "A"
Shall Section 17 of the City Charter be
amended to prohibit a councilmember from
residing outside the ward from which he or she
is elected?

MEASURE "B"
Shall Section (185)3 of the City Charter be
modified to allow that any member of the Fire
Department may be appointed Assistant Chief or
Deputy Chief, as is currently the case with
the Chief of the Fire Department?
YES NO
MEASURE "C"
Shall Section (217b)10b of the City Charter be
repealed to bring the lay-off policy into
compliance with current labor agreements?
YES NO
3. That the Board of Supervisors of the County of Kern
is hereby requested to make an order, pursuant to Sections 10403 et
seq. of the Elections Code of the State of California,
consolidating both the Primary Municipal Election for the Office of
Mayor and the Special Municipal Election for the purpose of
submitting to the qualified electors of the City amendments to the
Charter of the City of Bakersfield;
4. That the polls will be
holding said elections on said March 26,

open for the purpose of

5. That s~id Board is further requested to provide
election precincts, polling places, and voting booths within the
City of Bakersfield which shall, in every case, be the same and
that the Board of Supervisors provide only one set of election
officers in each of the precincts established in the City of
Bakersfield for the City elections.

6. That the Board of Supervisors of Kern County is
further requested to cause the list of candidates for Mayor of the
City of Bakersfield and the measures to be printed upon each of the
ballots to be used in the City of Bakersfield at said Primary
Municipal Election and Special Municipal Election for charter
amendments consolidated as requested, by the City of Bakersfield,
including absent voter ballots. Said Board is further requested to
cause to be set forth said office and measures on all sample
ballots relating to both City elections called and consolidated,
and to mail to the qualified electors within the City said sample
ballots and voter's pamphlets and arguments, if any, relating to
said elections, all in the time and in the form required by law,
and to provide absent voter ballots for said consolidated elections
for use by electors of the City of Bakersfield who may be entitled
thereto in the manner provided by law.
7. That the Bakersfield City Council authorize members
of its body, (a maximum of five) to file written arguments
regarding the City measures as specified above in accordance with
Article 4, Chapter 3, Division 9 of the Elections Code of the State
of California, and to change the arguments up until and including
the date fixed by the City Clerk after which no arguments for or
against the City measure may be submitted to the City Clerk.
8. That the Bakersfield City Council directs the City
Clerk to transmit a copy of the measures to the City Attorney,
unless the organization or salaries of the office of the City
Attorney are affected. The City Attorney shall prepare an
impartial analysis on each measure concerning the existing law and
the operation of the measure. If the measure affects the
organization or salaries of the office of the City Attorney, the
City Clerk shall prepare the impartial analysis. The impartial
analysis shall be filed by the date set by the City Clerk according
to law.
9. That the Board of Supervisors of the County of Kern
is hereby authorized to canvass, or cause to be canvassed, the
returns of said Primary Municipal Election for Mayor and Special
Municipal Election for Charter Amendments, and are requested to
provide a "Statement of Election Results" to the City Clerk.
10. That the City Clerk is hereby directed to transmit
and file certified copies of this resolution with the Board of
Supervisors of Kern County and the Chief Deputy Registrar of Voters
of Kern County, as required by Section 10403 of the Elections Code
of the State of California.
