HomeMy WebLinkAboutRES NO 158-95RESOLUTION NO. ~' 5 8 ' 9 5 A RESOLUTION MAKING FINDINGS THAT SUFFICIENT MAJORITY WRIrlVl'EN PROTEST HAS NOT BEEN FILED AND ORDERING THE TERRITORY DESIGNATED AS PROCEEDING NO. 1189, ANNEXATION NO. 385, KINGSLEY #1, ANNEXED TO THE CITY OF BAKERSFIELD AND INCLUDED IN THE GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT (WARD 6). WHEREAS, Resolution of Application No. 52-95, dated March 22, 1995, was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annexation of territory to the City of Bakersfield designated as Proceeding No. 1189, Annexation No. 385 (Kingsley No. 1), the exterior boundaries of which are described in Exhibit "A" attached hereto and incorporated as though fully set forth herein; and WHEREAS, a duly noticed public hearing upon said proposal was held before the Commission on August 22, 1995; and WHEREAS, following said public hearing the Commission, on August 22, 1995, adopted its Resolution Making Determination, being Resolution No. 95-19, recorded in Minute Book 42 of said Commission; and WHEREAS, 100 percent of the property owners of the territory have consented to annexation; and WHEREAS, said territory lies inside the Greater Bakersfield Separation of Grade District; and NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That said territory has 100 percent consent by the property owners. 2. That the said territory designated as Proceeding No. 1189, Annexation No. 385 (Kingsley No. I Annexation), and described herein, and every part thereof, is hereby ordered annexed to the City of Bakersfield. 3. That the Clerk shall forthwith transmit a certified copy of this resolution ordering a change of organization, along with any required remittance to cover the fees required by Section 54902.5 of the Government Code, to the Executive Officer of the Local Agency Formation Commission of Kern County. 4. That the Executive Officer of the Commission is hereby requested to prepare and execute a certificate of completion and make the filings required by Part 4, Chapter 8 of the Cortese-Knox Local Government Organization Act of 1985 and record a certified copy of the certification of completion with the recorder of Kern County, with the surveyor of Kern County and with the Clerk of the City of Bakersfield. 5. That the Clerk shall forthwith transmit a certified copy of this resolution to James R. Parker, Jr., c/o Greater Bakersfield Separation of Grade District, P.O. Box 2205, Bakersfield, CA 93303. Rd. NO. 1491) and the east line of Parcel 3 of Parcel MaD No. 6617, filed for record in Book 29 of Parcel Maps, Page 129 in the office of the Kern County Recorder, said point also being on the existing corporate boundary of the City of Bakersfield; THENCE (1) departing from said corporate boundary line, South 89'56'26" East, along said street right of way line, 612.98 feet to a point on the east right of way line of line of Castro Lane (Co. Rd. No. 50); THENCE (2) North 00'09'19" East, along said east line, 60.20 feet to a point on the north line of the south 285 feet of the west 145 feet of Lot 43 of Section 1, T. 30 S., R. 27E. per "Kern County Sales MaD NO. 1 of Lands of J. Haggin" filed for record May 3, 1889 in the office of the Kern County Recorder; THENCE (3) South 89'56'28" East, along said north line, 145.00 feet; THENCE (4) South 00'09'19" West, 315.00 feet to a point on the south right of way line of Talisman Drive ( Co. Rd. No. D-476); THENCE (5) North 89'56'28" West, along skid south line, 125.03 feet to the beginning of a 20.00 foot radius curve concave to the southeast (Co. Rd. No. 3072); THENCE (6) Southwesterly along said curve through a central angle of 89'54'13" an arc distance of 31.38 feet to a point of tangency on the east right of way line of Castro Lane /Co. Rd. No. 50); THENCE (7) South 00'09'19" West, along said east line, 85.48 feet to a point on the easterly prolongation of the north boundary line of Tract No. 2396 filed for Record in Book 12 of Maps, Page 46 in the office of the Kern County Recorder; THENCE (8) North 89'56'26" West (N. 89'56'56" W. Per Tr.
