RESOLUTION APPROVING THE APPLICATION FOR
FUNDS FOR THE TP. ANSPORTATION ENHANCEMENT
ACTIVITIES PROGRAM UNDER THE INTEP44ODAL
SURFACE TRANSPORTATION EFFICIENCY ACT OF
1991 FOR THE BAKERSFIELD CHESTER AVENUE
STREETSCAPE IMPROVEMENT PROJECT.
WHEREAS, the United States Congress has enacted the Intermodal
Surface Transportation Efficiency Act of 1991, which is intended to
provide over $200 million in federal dollars over a six-year period
as matching funds to local, state and federal agencies and non-
profit entities for transportation enhancement activities; and
WHEREAS, the Chester Avenue Streetscape Improvement Project
sets forth design standards for streetscape improvements in the
public right-of-way along Chester Avenue between Truxtun Avenue and
23rd Street; and
WHEREAS, the Chester Avenue Streetscape Improvement Project
area lies entirely within the City of Bakersfield's Redevelopment
Project Area; and
WHEREAS, the cost to complete the Chester Avenue Streetscape
Improvement Project is estimated to be $1.8 million; and
WHEREAS, City staff is pursuing several funding options to
fund the aforementioned project; and
WHEREAS, procedures and criteria established by the California
Department of Transportation require a resolution certifying the
approval of application by the applicant's governing body before
submission of said application to the California Transportation
Commission and the State of California; and
WHEREAS, the application contains assurances with which the
applicant must comply; and
WHEREAS, the proposed grant application and Chester Avenue
Streetscape Improvement project are categorically exempt from the
requirements of the California Environmental Quality Act; and
WHEREAS, based on a preliminary environmental studies form,
the proposed grant application and Chester Avenue Streetscape
Improvement Project qualify for a programmatic categorical
exclusion from the requirements of the National Environmental
Protection Act; and
WHEREAS, the applicant, if selected, will enter into an
agreement with the State of California to carry out the
transportation enhancement activities project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The Council approves the filing of an application for the
Transportation Enhancement Activities Program for
consideration for funding.

The Council certifies that said applicant will make
adequate provisions for operation and maintenance of the
project.
The Council appoints RAUL ROJAS, Public Works Director,
or his designee, as agent of the City of Bakersfield to
conduct all negotiations, execute and submit all
documents, including, but not limited to, application,
agreements, amendments, payment requests and so on, which
may be necessary for the completion of the aforementioned
project.
The City of Bakersfield will provide the required
matching funds as follows:
a)
Six Hundred Thousand Dollars ($600,000) shall be
allocated from the City's Community Development
Block Grant entitlement; and
b)
Six Hundred Thirty-Six Thousand Dollars ($636,000)
shall be allocated from a combination of general
fund monies and redevelopment tax-increment monies.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular
