A RESOLUTION DISPENSING WITH BIDDING DUE TO
EMERGENCY TRUNK SEWER LINE REPAIRS UNDER THE
KERN RIVER ALONG BUENA VISTA ROAD ALIGNMENT.
WHEREAS, on Wednesday, September 20, 1995, a break in the top of the
Buena Vista 42" trunk sewer line and subsequent erosion of soil into the sewer
occurred; and
WHEREAS, on Monday, September 25, 1995 a sewer video camera detected
roughly 1,000 feet of additional defective trunk sewer line underneath the Kern River along
the Buena Vista Road Alignment which could result in a collapse; and
WHEREAS, on Tuesday, September 26, the Public Works Director determined
that trunk sewer line repairs would require outside forces in addition to City staff in order
to remedy the problem; and
WHEREAS, the Public Works Director determined that the defective trunk
sewer line underneath the Kern River could result in a collapse and constituted an
imminent risk to public health and that the immediate preservation of the public health
required the use of outside forces to repair the defective trunk sewer line and insure that
no future collapse would occur that might pollute the Kern River; and
WHEREAS, in order to remedy this emergency situation, the Public Works
Director authorized equipment rental, engineering and construction services on a time-and-
materials basis to construct a sewer by-pass system, repair parts of the existing trunk sewer
line and install new sewer pipe in order to prevent a future collapse.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by
reference.
2. City Council hereby determines that based on the above recitals an
emergency impacting the public health exists thereby allowing the dispensing of bidding
requirements or bidding procedures as set forth in Section 136 of the City Charter and
Section 3.20.060 of the Bakersfield Municipal Code.
