HomeMy WebLinkAboutRES NO 152-95RESOLUTION NO. 1 5 2 ' 9 5 A RESOLUTION REQUESTING THE KERN COUNTY LOCAL AGENCY FORMATION COMMISSION TO APPROVE A REVISION OF THE CITY'S SPHERE OF INFLUENCE AND THAT SUCH REQUEST CAN BE CONSIDERED AND STUDIED AS PART OF THE PERIODIC REVIEW. WHEREAS, a "sphere of influence" means a plan for the probable physical boundaries and service area of a local government agency; and WHEREAS, the Local Agency Formation Commission is required to determine the sphere of influence of each local governmental agency within the county in order to carry out its purposes and responsibilities for planning and shaping the logical and orderly development and coordination of such agencies so as to advantageously provide for the present and future needs of the county and communities; and WHEREAS, if any city desires amendment of an adopted sphere of influence, the City Council by resolution (pursuant to Section 56428 of the Government Code) may file a request therefore with the executive officer who shall present same for approval; and WHEREAS, no change in zone or annexation is proposed by this project; and WHEREAS, city staff will compile and submit all necessary data as it is directed by LAFCO to complete an application to amend the Sphere of Influence boundary; and WHEREAS, the state water bank area makes a logical western boundary for the City of Bakersfield; and WHEREAS, the City of Bakersfield is the only local jurisdiction able to provide urban services to this area; and WHEREAS, most of the area under consideration is either designated for urban land uses or in the process to be designated as urban; and NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: The above recitals and findings incorporated herein, are true and correct. 2. Staff is directed to make application to LAFCO to amend the Sphere of Influence. 3. The report from the Planning Department, all public correspondence and testimony has been taken into consideration by this Council. 4. That the City Council hereby requests revision of the City of Bakersfield's adopted sphere of influence by the Kern County Local Agency Formation Commission under the provisions of Government Code Section 56428, to add lands that could be annexed and served by the City of Bakersfield in the future, described as follows: SPHERE OF INFLUENCE AMENDMENT 1-95 Additions to sphere of influence Township 30 south, Range 26 east M.D.B.&M., Sections 4, 9, 10, 11, 14, 15, 16, 21, 22, 23 and a portion of Section 3. As depicted in Exhibit "A". 5. That the City Council hereby requests the Kern County Local Agency Formation Commission to find that this request for revision of the Bakersfield Sphere of Influence can be considered and studied as part of the periodic review of spheres of influence required by Government Code Section 56425 and that such Commission waive reimbursement as provided in Government Code Section 56428. 6. The City Clerk is directed to transmit a certified copy of this resolution to the Executive Officer of the Kern County Local Agency Formation Commission. .........
