A RESOLUTION MAKING FINDINGS AND APPROVING
A NEGATIVE DECLARATION FOR THE IMPROVEMENT
AND RECONSTRUCTION OF STATE ROUTE-99/
PANAMA LANE INTERCHANGE.
WHEREAS, the City Council of the City of Bakersfield, in accordance
with the provisions of Section 15072 of the State CEQA Guidelines, held a public
meeting to approve a Negative Declaration at its regularly scheduled meeting of
WEDNESDAY, NOVEMBER 8, 1995, notice of the Negative Declaration having been
given at least twenty-one (21) calendar days before said meeting by publication in the
Bakersfield Californian, a local newspaper of general circulation, notices being sent to
property owners within 300 feet radius of the State Route-99/Panama Lane Interchange;
and
WHEREAS, the improvement and reconstruction of the State
Route-99/Panama Lane Interchange is as follows:
IMPROVEMENT AND RECONSTRUCTION OF STATE
ROUTE-99/PANAMA LANE INTERCHANGE:
The City of Bakersfield in cooperation with the California Deparl~nent of
Transportation (Caltrans) is proposing to improve the operational
conditions and traffic car~ing capacity of the State Route 99 (hereafter
known as SR-99) and Panama Lane interchange in Bakersfield (Figures I
and II). Subject site is located in the south Bakersfield area. Three
project alternatives, including the no-project alternative, are being
considered. Proposed improvemeuts would include widening the existing
two-lane Panama Lane bridge (Bridge No. 50-247), widening Panama Lane
to accommodate six lanes of traffic, relocation and widening of the
interchange ramps, and signalization of the off-ramp/Panama Lane
intersections. This project is to be funded by the City of Bakersfield under
the Capital Improvements Program. The improvement and reconstruction
of State Route-99/Panama Lane Interchange will take place in the existing
public right-of-way. Additional right-of-way will not be required.

WHEREAS, for the above-described Improvement and Reconstruction, an
Initial Study was conducted, and it was determined that the proposed project would not
have a significant effect on the environment, and a Negative Declaration with mitigation
was prepared; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's
CEQA Implementation Procedures have been duly followed by city staff: and

WHEREAS, the Council has considered and hereby makes the following

significant effect on the environment.
4. Mitigation measures attached to the project as Exhibit "A" are
included in the project to mitigate impacts.
5. The proposed improvement and reconstruction is compatible with
existing land use designations, zoning districts and land uses adjacent to the interchange
and the general area of the interchange.
6. The proposed interchange improvement and reconstruction are
necessa~3~ for accommodating existing traffic and for the future development of the
surrounding area.
7. Improvement and reconstruction of the interchange will not cause
displacement of people, or structures.
8. Public necessity, convenience, general welfare and good engineering
practice justify the proposed improvement and reconstruction of the interchange.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and
correct.
2. The Negative Declaration for the improvement and reconstruction State
Route-99/Panama Lane Interchange is hereby approved and adopted.
