A RESOLUTION MAKING FINDINGS AND APPROVING
NEGATIVE DECLARATION FOR PLANNED IMPROVE-
MENTS TO ROSEDALE HIGHWAY (STATE ROUTE 58),
COFFEE ROAD, AND BRIMHALL ROAD.
WHEREAS, the Circulation Element of the Metropolitan Bakersfield 2010
General Plan calls for provision of a safe and efficient street system that links all parts
of the metropolitan area for movement of people and goods, and for developing and
maintaining a circulation system that supports the land use plan shown in the General
Plan; and
WHEREAS, the Circulation Element policies call for the provision of new
transportation facilities as needed based on existing usage and future demand; and
WHEREAS, the Public Works Department of the City of Bakersfield has
proposed a number of improvements to Rosedale Highway, Coffee Road, Brimhall
Road, and the right of way of the Friant-Kern Canal in conjunction with improvements
to an industrial/commercial parcel map in the vicinity,; and
WHEREAS, said improvements will contribute to the provision of a safe
and efficient street system while preventing degradation of future traffic service levels
below Level of Service "C", as required by the policies of the 2010 General Plan; and
WHEREAS, notice of the time and place of hearing having been given at
least twenty-one (21) calendar days before said hearing by publication in the Bakersfield
Californian, a local newspaper of general circulation; and
WHEREAS, for the above-described street improvements, an Initial Study
was conducted, and it was determined that the proposed project would not have a
significant effect on the environment, and a Negative Declaration with mitigation was
prepared; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's
CEQA Implementation Procedures have been duly followed by city staff; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of CEQA and City of Bakersfield's CEQA Implementation Procedures,
conducted and held a public hearing on WEDNESDAY, NOVEMBER 8, 1995, on the
above described Negative Declaration, notice of time and place of the hearing having
been given at least ten (21) calendar days before the hearing by publication in the
Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, the Council has considered and hereby makes the following
findings:
1. The proposed improvements to Rosedale Highway, Coffee Road,
and Brimhall Road are consistent with the goals and policies of the Circulation Element
of the Metropolitan Bakersfield 2010 General Plan.
2. The project will contribute toward the provision of a safe and
efficient street system that links all parts of the metropolitan area for movement of
people and goods, and for developing and maintaining a circulation system that supports
the land use plan shown in the General Plan.
3. The project will result in the provision of new transportation
facilities as needed based on existing usage and future demand.
4. The project will aid in preventing the degradation of future traffic
service levels below Level of Service "C", as required by the policies of the 2010 General
Plan.
5. An Initial Study has found that the proposed transportation
improvements will not have a significant adverse effect on the environment.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
I. The above recitals and findings, incorporated herein, are true and
correct.
2. The City Council hereby approves and adopts the Negative Declaration
for the planned improvements to Rosedale Highway (State Route 58), Coffee Road, and
Brimhall Road, subject to the mitigation measures listed in Exhibit "A".

Widening of Portions of Rosedale Highway, Coffee Road, and Brimhall Road,
Construction of Local Street Access Points, and Related Intersection, Traffic
Signal and Bridge hnprovements in the Northwest Bakersfield Area
Recommended Mitigation Measures
PRIOR TO INITIATION OF ANY GRADING OR SITE DISTURBANCE
ACTIVITIES, the City of Bakersfield Public Works Department shall submit to the
California Regional Water Quality control Board office, a copy of the Site
Characterization Report for the Coffee Road property, prepared by Kennedy/Jenks
Consultants, July 13, 1995, for that agency's review, comments and recommendations.
The Public Works Department shall ensure compliance with any additional
mitigation measures recommended by the Regional Water Quality Control Board
during all phases of project implementation.
The City of Bakersfield Public Works Department shall incorporate into the design
of all roadway and appurtenant improvements measures that will minimize the
potential for migration of constituents identified in the above-referenced Site
Characterization Report completed by Kennedy/Jenks Consultants dated July 13,
1995. Such measures shall, at a minimum, prevent the percolation of water through
the identified areas of concern, and ensure that all future stormwater flows be
drained away from such area.
