A RESOLUTION AMENDING RESOLUTION NO. 172-95,
APPROVING THE DESTRUCTION OF CERTAIN
ADDITIONAL OBSOLETE CITY RECORDS, DOCUMENTS,
INSTRUMENTS, BOOKS AND PAPERS, PURSUANT TO
SECTION 34090 ET SEQ. OF THE GOVERNMENT CODE OF
THE STATE OF CALIFORNIA (CITY ATTORNEY'S OFFICE).
WHEREAS, on November 8, 1995, the City Council approved Resolution No. 172-
95, approving the destruction of certain obsolete city records, documents, instruments,
books and papers in the charge of the City Attorney; and
WHEREAS, California Government Code § 34090 permits, with certain exceptions,
the head of a city department to destroy any city record, document, instrument, book or
paper under his charge, without making a copy thereof, after the same is no longer
required, with the approval of the City Council by resolution and the written consent of the
City Attorney; and
WHEREAS, the City Attomey has a large number of obsolete litigation files which
were closed before 1990 and which are no longer required; and
WHEREAS, the City Attorney would like to destroy these records, as well as all
litigation files over ten years old.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:

destroy those obsolete litigation files which were closed prior to 1990, and all other
obsolete litigation files as they become ten years old.
