' 9 5 A RESOLUTION APPROVING PROPOSED AMENDMENT NO. 192-15A TO THE COUNTY OF KERN SOL1D WASTE MANAGEMENT PLAN WHEREAS, the County of Kern on October 2, 1995, has referred to the City of Bakersfield an application for an amendment to the County Solid Waste Management Plan (CoSWMP) submitted on behalf of the U.S. Borax Company; and WHEREAS, the State of California has enacted legislation pursuant to Chapter 1617 of the Statutes of 1990 which governs the process for the approval of solid waste facilities in the interim period until a new Countywide Integrated Waste Management Plan is approved in accordance with the California Integrated Waste Management Act of 1989 (AB 939); and WHEREAS, the County of Kern has modified its approval procedures for amendments to the County Solid Waste Management Plan to require that a majority of the incorporated cities within the County which contain a majority of the population of the incorporated area of the County either approve or disapprove such amendments by resolution within 90 days of receipt of the amendment from the County; and WHEREAS, said request for amendment to the County Solid Waste Management Plan submitted on behalf the U.S. Borax Company, Amendment No. 192-15A, proposes inclusion of a 60 acre site as an existing non-municipal waste Class III landfill, and existing mining waste management unit for Group C nonhazardous mining waste, solid waste, and inert waste; and WHEREAS, subject site is located approximately three miles northwest of Boron, within the boundaries of the 3,800 acre U.S. Borax Mine Facility; and WHEREAS, the site is designated 7.3 (Heavy Industrial) by the Kern County General Plan; and WHEREAS, on August ll, 1995, the County of Kern Solid Waste Management Advisory Committee (SWMAC) considered said amendment, found it to be consistent with the policies of the Kern County Solid Waste Management Plan and recommended approval of the amendment as requested; and WHEREAS, on September 19, 1995, the Board of Supervisors of the County of Kern considered said amendment to the County Solid Waste Management Plan, approved said amendment as requested, and adopted the Negative Declaration as prepared by the Lead Agency; and WHEREAS, the Board of Supervisors of the County of Kern on the same date directed that copies of the amendment be referred to the incorporated cities within the County; NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The City Council hereby approves the proposed amendment to the County of Kern Solid Waste Management Plan submitted on behalf the U.S. Borax Company (Amendment No. 192-15A), requesting inclusion of the affected site as an existing non-municipal waste Class II1 landfill and existing mining waste management unit for nonhazardous mining waste, solid waste and inert waste. 3. The City Council concurs in the finding made by' the Board of Supervisors of County of Kern on September 19, 1995, that said Amendment No. 192-15A is consistent with the policies of the Kern County Solid Waste Management Plan and the revision thereof to include the above referenced site. .........
