A RESOLUTION MAKING FINDINGS, APPROVING
NEGATIVE DECLARATION AND ADOPTING SEGMENT
IV OF PROPOSED AMENDMENT TO THE KERN RIVER
PARKWAY PLAN (KERN RIVER PARK%VAY PLAN
AMENDMENT 1-95).
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on MONDAY, SEPTEMBER 18, 1995, and THURSDAY, SEPTEMBER 21, 1995,
on Segment IV of a proposed amendment to the Kern River Parkway Plan, notice of the
time and place of hearing having been given at least twenty-one (21) calendar days
before said hearing by publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such Segment IV of the proposed amendment to the Kern
River Parkway Plan is as follows:
SEGMENT IV:
The CITY OF BAKERSFIELD has applied to amend the
Kern River Parkway Plan which will include establishing two
"staging" areas along the north side of the Kern River at
Mohawk Street and the other just east of Enos Lane;
and
WHEREAS, for the above-described Segment, an Initial Study was
conducted, and it was determined that the proposed project would not have a significant
effect on the environment, and a Negative Declaration with mitigation measures was
prepared; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's
CEQA Implementation Procedures have been duly followed by city staff and the
Planning Commission; and
WHEREAS, by Resolution No. 68-95 on September 21, 1995, the Planning
Commission recommended approval and adoption of Segment IV subject to mitigation
measures listed in Exhibit "A" and this Council has fully considered the findings made by
the Planning Commission as set forth in that Resolution; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, conducted and held a public
hearing on WEDNESDAY, NOVEMBER 8, 1995, on the above described Segment IV of
the proposed amendment to the Kern River Parkway Plan, notice of time and place of
the hearing having been given at least ten (10) calendar days before the hearing by
publication in the Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, the Council has considered and hereby makes the following
findings:
1. All required public notices have been given.
2. The provisions of California Environmental Quality Act (CEQA)
have been followed.
3. Based on the Initial Study and comments received, staff has
determined that the proposed project could not have a significant effect on the
environment. A Negative Declaration with mitigation measures was advertised and
posted on July 21, 1995, in accordance with CEQA.

NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and
correct.
2. The Negative Declaration for Segment IV is hereby approved and
adopted.
3. The report of the Planning Commission, including maps and all reports
and papers relevant thereto, transmitted by the Secretary of the Planning Commission to
the City Council, is hereby received, accepted and approved.
4. The City Council hereby approves and adopts Segment IV of the

constituting changes as shown on the map marked Exhibit "B," attached hereto and
incorporated as though fully set forth, for property generally located along the north side
of the Kern River at Mohawk Street and the other east of Enos Lane, subject to
mitigation measures shown on Exhibit "A."
5. That Segment IV, approved herein, be combined with other approved
segments described in separate resolutions, to form a single Kern River Parkway Plan
Amendment, GPA 3-95.

General Plan Amendment 3-95, Segment IV
Mitigation Measures
The City of Bakersfield shall post and maintain signs at each "staging" area within the City of
Bakersfield 2800-acre recharge area that will inform the public that the Kern Mosquito and
Vector Control District is involved in mosquito control activities.
Prior to engaging in any mosquito control activities in the City of Bakersfield 2800-acre recharge
area, the Kern Mosquito and Vector Control District shall notify the city Water Resources
Department. The Water Resources Department shall chain close the Equestrian/Pedestrian
"staging" area(s) within the 2800-acre recharge area during the time of the mosquito control
operations.
Prior to construction of any of the staging areas, paved access from the bike path to the staging
areas should be required.
The staging areas located on the north side of the Kern River, that are within the North
Bakersfield Recreation and Parks District (NBRPD) should be maintained by that district. The
City would be willing to maintain the areas not in the NBRPD.
Funds for maintenance of these areas under the current setup would come from the general fund.
If it is not the desire of the City Council to pay for maintenance of the areas with general fund
monies, then an alternative form of maintenance should be proposed, i.e. maintenance district, etc.
The calculation for maintenance of a typical staging area as proposed is as follows:
43,560 sq.ft. (average total area) + 2 = 21,780 sq.ft. landscaped area and 21,780 sq.ft. parking area
Landscaped area:
21,780 x $.35 (cost per sq.ft.) = $7,623 per year/area
Parking area:
21,780 x $.18 (cost per sq.ft.) = $3,920 per yearb~rea
