HomeMy WebLinkAboutRES NO 181-95RESOLUTION NO. 1 8 1 - 9 5 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CONFIRMING THE REPORT OF THE BUILDING DIRECTOR REGARDING ASSESSMENTS OF CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD FOR THE ABATEMENT OF CERTAIN WEEDS, DEBRIS AND WASTE MATTER. WHEREAS, the properties in the City of Bakersfield described by assessor parcel number and street address in Exhibit "A", attached hereto and incorporated by this reference herein, were determined to be a public nuisance under Bakersfield Municipal Code Chapter 8.28 because of the presence of hazardous weeds, debris and waste matter; and WHEREAS, notice and orders of the City of Bakersfield Building Department, as provided in Chapter 8 of the above specified code, were mailed to the record owners of the aforementioned properties; and WHEREAS, the properties in question were duly posted as provided in Chapter 8 of said Code; and WHEREAS, the abatement of said public nuisance was performed pursuant to Resolution No. 95-95, passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 14th day of June, 1995; and WHEREAS, this assessment proceeding was duly noticed and a public hearing held on November 29, 1995, in the Council Chambers of the City of Bakersfield. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield: 1. The cost for the weed and waste matter abatement on the properties described in Exhibit "A", attached hereto and made a part hereof by this reference, are hereby made a special assessment against said properties. 2. That the Report and Assessment List for weed and waste matter abatement of Dennis C. Fidler, Building Director, attached hereto as Exhibit "A", including the assessments therein set forth, is hereby confirmed. 3. That the property owners named in said Exhibit "A" may pay, or cause to be paid, the charges stated therein at the. office of the Treasurer, 1715 Chester Avenue, Bakersfield, California, at any time before 5:00 p.m., June 30, 1996. 4. That in the event such charges assessed and confirmed against the property as listed in Exhibit "A" are not paid in full within such time, such assessment or balance due remaining thereof, shall be recorded on the assessment roll, and said assessment shall constitute a special assessment against and a lien upon the property. The City Finance Director shall cause the amount of said assessments remaining unpaid against the property to be entered and extended on the property tax roll, and pursuant to law, the County tax collector shall be included on the tax bill applicable to the property. ......... 000 ........ 2 I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on #0¥ 2 O ~95 , by the following vote: AYES: COUNCILME..t~..E.R. I am the duly appointed building director of the City of Bakersfield, 2. Pursuant to Resolution No. 95-95, passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 14th day of June, 1995, the abatement of hazardous weeds, debris and waste matter on the aforementioned properties was undertaken in August 1995. 3. The presence of the weeds and debris on the aforementioned properties constituted a fire hazard and a nuisance to the public. 4. Records of the Bakersfield Building Department reflect that on November 13, 1995, copies of the Notice of Filing Report and Assessment List for Abatement of Certain Weeds, Debris and Waste Matter and of Hearing Thereon were mailed to the owners of the properties. 5. The foregoing matters are within my personal knowledge and if called as a witness herein, I could and would competently testify thereto. I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct. Executed this 13th day of November 1995, at Bakersfield, California. Dennis C.
