HomeMy WebLinkAboutORD NO 3790ORDINANCE NO. 3 ? 9 0 AN ORDINANCE AMENDING TITLE t7 OF THE BAKERSFIELD MUNICIPAL CODE AND CITY ZONING MAP NOS. 102-09, 102-16, 101-25 AND 101-35 BY PREZONING PROPERTY LOCATED (1) SOUTH OF SNOW ROAD TO THE CITY LIMITS, NORTH OF HAGEMAN ROAD, BETWEEN FRUITVALE AVENUE AND COFFEE ROAD; (2) SOUTH OF ROSEDALE HIGHWAY TO BRIMHALL ROAD, BETWEEN ALLEN ROAD AND JEWETTA AVENUE; (3) AT THE NORTHWEST CORNER OF STOCKDALE HIGHWAY AND ALLEN ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on MONDAY, JULY 14, 1997, and THURSDAY, JULY 17, 1997, to consider zoning certain property, and made several general and specific findings of fact which warranted a negative declaration of environmental impact; and WHEREAS, Annexation prezoning area comprises approximately 1,420 acres of land contiguous to the boundary of the City of Bakersfield, as shown on the attached maps marked Exhibit "B"; and WHEREAS, by Resolution No. 53-97 on July 17, 1997, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve Prezoning No. P97-0296 to City A, OS, RS-5A, RS- 2.5A, RS-1A, RS-1A CH, RS, E, R-2, R-3, 'l-r, c-1 and C-2 zones as set forth in said resolution; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, Planning Commission and this Council; and WHEREAS, this Council has fully considered the findings made by the Planning Commission as set forth in that resolution; and WHEREAS, a Negative Declaration was posted on June 23, 1997, and advertised in the local newspaper on June 13, 1997, in accordance with CEQA; and WHEREAS, the City Council has considered and hereby makes the following findings: 1. All required notices have been given. Notices of public hearing before the Planning Commission of the City of Bakersfield have been advertised in the Bakersfield Californian newspaper and posted on the bulletin board of the Bakersfield City Planning Department on June 13, 1997. The advertisement was 1/8 page in size. 2. The provisions of CEQA have been followed. Based upon an initial environmental assessment, staff has determined the proposed project will not significantly affect the physical environment and the issuing of a Negative Declaration for the project is adequate. The project site has been developed in the County as residential, commercial and open space uses. 3. Proposed Prezoning No. P97-0296 is consistent with the Metropolitan Bakersfield 2010 General Plan. The project site is designated Suburban Residential, Estate Residential, Public Services and General Commercial on the Land Use Element of the Metropolitan Bakersfield 2010 General Plan. WHEREAS, the City Council has determined after due consideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. SECTION 1. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. The Negative Declaration for this prezoning action is hereby approved and adopted. 3. That Title Seventeen of the Bakersfield Municipal Code of the City of Bakersfield and City Zoning Map Nos. 102-09, 102-16, 101-25 and 101-35 is hereby amended by prezoning said property and extending the boundaries of said map to include that certain property in the County of Kern located (1) south of Snow Road to the City limits, between Coffee Road and Fruitvale Avenue; (2) south of Rosedale Highway to Brimhall Road, between Jewetta Avenue and Allen Road and (3) at the northwest corner of Allen Road and Stockdale Highway contiguous to the boundary of the City of Bakersfield the zoning designations and boundaries of which property are shown on the maps marked Exhibit "B", hereto attached and made a part of this ordinance, and are more specifically described in attached Exhibit "A". SECTION 2. This ordinance shall be posted in accordance with the Bakersfield Municipal Code and shall become effective upon the annexation of the above-described territory to the City of Bakersfield, but not less than thirty (30) days from and after the date of its passage.
