RESOLUTION NO.
RESOLUTION ACCEPTING STREET AND LIGHTING
IMPROVEMENTS ON LANCER DRIVE AND LANCER COURT
FOR MAINTENANCE BY THE CITY OF BAKERSFIELD.
WHEREAS, Lancer Drive and Lancer Court were improved in
connection with development of Tract No. 4662 in northeast
Bakersfield in 1986; and
WHEREAS, those street and lighting improvements have
subsequently and continuously been maintained by the Lancer Drive
Homeowner's Association; and
WHEREAS, the Lancer Drive Homeowner's Association has
requested maintenance of these facilities be assumed by the City of
Bakersfield; and
WHEREAS, City staff has reviewed existing status of
improvements and specified certain conditions to be satisfied prior
to City acceptance of improvements for maintenance; and
WHEREAS, these conditions including granting of an
easement to the City, payment of $10,300 in the City street
maintenance account as a proportionate share to rehabilitate the
pavement in the future, completion of sidewalks, and acknowledgment
that existing roll-top curbs will diminish street sweeping
effectiveness have all been satisfied.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The foregoing recitals are true and correct and
incorporated herein.
2. That the City of Bakersfield hereby accepts the
street and lighting facilities on Lancer Drive and Lancer Court
within Tract 4662 in Northeast Bakersfield for maintenance.
