RESOLUTION OVERTURNING THE DECISION OF THE
BOARD OF ZONING ADJUSTMENT DENYING A
MODIFICATION TO ALLOW THE ELIMINATION OF THE
REQUIRED OFF-STREET PARKING AND REDUCTION OF
THE REQUIRED SIDE YARD FROM 5 FEET TO 3 FEET 8
INCHES AT 1217 DORIAN WAY.
WHEREAS, JIMMIE GRIDER, desires a modification to Section 17.58.110(1) to
eliminate the required off-street parking of a single family residence and Section
17.10.050 to reduce the required side yard from 5 feet to 3 feet 8 inches; and
WHEREAS, at a noticed public hearing held on February 8, 1994, the application
was duly heard and considered and the Board of Zoning Adjustment, by its Resolution
No. 3-94, denied the requested modification; and
WHEREAS, within the time prescribed by law, JIMMIE GRIDER filed an
appeal in writing with the Council of the City of Bakersfield appealing the denial of the
modification; and
WHEREAS, a notice was duly given as provided in Title Seventeen of the
Bakersfield Municipal Code setting the time and place for a public hearing before this
Council on said appeal, which public hearing was held before the Council of the City of
Bakersfield on March 23, 1994.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that, based upon the record of proceeding before the Board of Zoning
Adjustment and the proceeding before and findings of this Council, the appeal of
JIMMIE GRIDER from the decision of the Board of Zoning Adjustment is hereby
granted.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
