RESOLUTION DENYING A CONDITIONAL USE PERMIT TO
ALLOW THE CONSTRUCTION OF AN 1,800 SQUARE FOOT
ADDITION TO AN EXISTING METAL BUILDING FOR
STORAGE OF PARTS AND EQUIPMENT ASSOCIATED WITH
RACING OPERATIONS.
WHEREAS, Marion Collins of Mesa Marin Raceway, pursuant to Section 17.66.020
of the Bakersfield Municipal Code, has applied for a conditional use permit to construct an
1,800 square foot addition to an existing metal building for storage of parts and equipment
associated with racing operations; and
WHEREAS, said facility must obtain a conditional use permit from the City Council
to be established; and
WHEREAS, a duly noticed public heating before the City Council was held on May
4, 1994; and
WHEREAS, the Council considered all public testimony relative to the project; and
WHEREAS, the Council considered the staff report prepared for this project where
staff recommended approval of the proposal subject to conditions;
WHEREAS, the Council was updated on the status of Conditional Use Permit
#5216 which had extended the applicant's overall raceway facility and it was identified that
three conditions of approval have not been satisfied; therefore, the building expansion
should not be permitted until such time the applicant has demonstrated that all conditions
of approval for Conditional Use Permit #5216 are in compliance.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield that pursuant to Bakersfield Municipal Code Section 17.66.020, said Conditional
Use Permit is hereby denied.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
