I 6 2 ' 9 9 A RESOLUTION MAKING FINDINGS, AND ADOPTING PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (LAND USE ELEMENT AMENDMENT CASE NO. P99-0433). WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65353 of the Government Code, held a public heating on MONDAY, SEPTEMBER 13 and THURSDAY, SEPTEMBER 16, 1999 on a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such proposed amendment to the Land Use Element of Metropolitan Bakersfield 2010 General Plan is as follows: Jim Ward Architecture for Riverlakes Community Church has applied to amend the Land Use Element of the Metropolitan Bakersfield 2010 General Plan consisting of a request for eliminating the requirements of the Polo Grounds Multi-Use Trail Plan (Trail B) along the north side of Hageman Road between Verdugo lane and Calloway Drive, and along the west side of Calloway Drive between Noriega Road and Hageman Road; and WHEREAS, for the above-described amendment, it was determined that the proposed project is exempt fi'om CEQA pursuant to Section 15061 (b)(3) of the CEQA Guidelines (General Rule), as there is no possibility that the proposed amendment to the Land Use Element eliminating the requirements of the Polo Grounds Multi-Use Trail Plan (Trail B) along said portions of Hageman Road and Calloway Drive, could have a significant effect on the environment; and WHEREAS, by Resolution No. 149-99 on September 16, 1999, the Planning Commission recommended approval and adoption of this General Plan Amendment, subject to the provisions and standards shown on Exhibit "A", and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public heating on WEDNESDAY, NOVEMBER 3, 1999, on the above described proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian. a local newspaper of general circulation; and WHEREAS, the Council has considered and hereby makes the following findings: 1. All required notices have been given. 2. The project has been found to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15061 (b) (3) of the CEQA Guidelines, on the basis that the requested deletion of the trails standards required by the Polo Grounds Multi Use Trails Plan could not have a significant effect on the environment because it is a minor change in adopted improvement standards for the area. 3. A Notice of Exemption has been completed for the project, and will be filed ~vith the County Clerk upon approval of the project. 4. The proposed amendment is consistent with surrounding land use designations and Circulation Element standards. 5. Approval of the trail standards deletion along Calloway Drive south from Noriega Road, and along Hageman Road east from Verdugo Lane, is justified to avoid a discontinuity in trails standards only on the applicant's property. 6. An alternate trail alignment (Trail A) is available along Noriega Road extending west to Verdugo Lane, then turning south and continuing to Hageman Road and can continue to provide continuity within the trails network in support of the objectives of the Polo Grounds Multi Use Trails Plan. 7. Approval of the requested amendment will not be contrary to the protection of the public health, safety and welfare of residents on the Polo Grounds, nor to uses of the trail plan. 8. The requirement for the retention and maintenance landscaped strips of a width equivalent to the easement that would be required for the trail alignment will ensure the maintenance of consistent improvement standards and appearance throughout the Polo Grounds. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 3. The report of the planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts General Plan Amendment Case No. P99-0433, a proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, constituting changes as shown on the map marked Exhibit "B", subject to the standards shown on Exhibit "A" attached hereto. THILTGEN City Attorney By:. ~ ~'-/ ~ MJM October 5, 1999 res\0433 EXHIBIT "A" GENERAL PLAN AMENDMENT P99-0433 AMENDMENT TO THE POLO GROUNDS MULTI-USE TRAIL PLAN STANDARDS, RIVERLAKES COMMUNITY CHURCH, APPLICANT PART 1: Along the entire frontage of the applicant's, Riverlakes Community Church, property, described as Assessors Parcel No. 493-020-06, at 4301 Calloway Drive, the following: Type "A" sidewalk along Calloway Drive, from the intersection with Hageman Road to a point approximately 1,320 north of the intersection corner No concrete rail fence or block wall shall be required along this frontage. This includes the existing and future phases of the church development as approved pursuant to Site Plan Review No. P97-0857 on January 13, 1998. PART2 PART3 Along the entire frontage of the applicant's property on Hageman Road, from the intersection with Calloway Drive westerly to a point approximately 666 feet west: A meandering sidewalk a minimum of 8 feet wide within a landscaped right-of way and/or easement between the curb and developed portion of the property. No concrete rail fence or block wall shall be required within said landscaped easement. For the undeveloped 6 acre parcel within Tract Map 5932 adjacent to the northerly boundary of the existing Rivedakes Community Church property, described as, Parcel E of Lot Line Adjustment P98-0845: Trail B section as depicted in the Polo Grounds Multi-Purpose Trail Plan as shown on the map, cross section and text description dated December 21, 1992. SHOULD THIS PARCEL ULTIMATELY BE ACQUIRED AND DEVELOPED BY THE RIVERLAKES COMMUNITY CHURCH, only an 8 foot minimum width meandering sidewalk within a landscaped right-of-way inside the curb shall be required along the Calloway Drive frontage of this parcel. The sidewalk and adjacent landscaped strips together shall be of the same width as otherwise required for the Trial B standard described in the foregoing paragraph.
