A RESOLUTION GRANTING PERMISSION TO
~T.T.OW OVERHEAD ELECTRICAL LINES IN
AN ELECTRIC UNDERGROUND DISTRICT.
WHEREAS, Ordinance No. 1215 passed in 1958 by the
Bakersfield City Council established an Electric Underground
District that encompasses a large portion of the downtown area,
including the area occupied by the Haberfelde Building; and
WHEREAS, Section 3 of that Ordinance provides that the
City Council may grant permission to install overhead structures
within the Electric Underground District, on such terms as the
Council may deem appropriate, in cases of unusual circumstances;
and
WHEREAS, Berkshire Properties, Inc., the new owners of
the Haberfelde Building, the Sullivan Building, and the original
Elks Club Building, is renovating these structures for several new
businesses; and
WHEREAS, additional three-phase, 220-volt electric
service is necessary for electrical services for a new restaurant
and a new bakery planning to locate in the Haberfelde Building;
WHEREAS, because of unusual circumstances which include
existing utility service limitations, PG&E vault location
limitations, and the cost and difficulty in making major
renovations to older buildings, it is necessary and appropriate to
make new service drops from existing power poles adjacent to the
Haberfelde Building;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. All the above recitals are true and correct and
incorporated herein by reference.
2. The Council hereby finds that, based on the
above recitals, overhead electrical facilities supplying electrical
services to the above-described restaurant and bakery in the
Haberfelde Building are permissible for a period of two (2) years
from the date of passage of this Resolution, subject to appeal at
that time, to complete the undergrounding of said electrical
facilities.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
