A RESOLUTION ORDERING THE SUMMARY VACATION OF A PORTION OF THE
FUTURE STREET AREA ON THE NORTH SIDE OF BRUNDAGE LANE, WEST OF "T"
STREET (AS SHOWN ON PARCEL MAP NO. 6171)IN THE CITY OF BAKERSFIELD
WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code authorizes the City
Council to summarily vacate certain public street or highway rights of way; and
WHEREAS, PICO-WINDSOR CORPORATION, petitioned the Council to vacate a portion of the
future street area on the north side of Brundage Lane, west of "~ Street (as shown on Parcel Map No. 6171)
in the City of Bakersfield described in full in Exhibit "A" attached hereto and incorporated as through fully
set forth herein, and
WHEREAS, the subject future street area is eligible for summary vacation on the basis that said area
has been determined to be excess right of way of a public street not required for street or highway purposes;
and
WHEREAS, said future street area is unnecessary for p/'esent or prospective public street purposes;
and
WHEREAS, The Planning Commission, at its meeting of May 5, 1994, considered and found that the
proposed vacation is consistent with the Metropolitan Bakersfield 2010 General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. All the foregoing recitals are found to be true and correct.
2. The proposed vacation is consistent with the Metropolitan Bakersfield 2010 General Plan.
3. In accordance with Sections 8334 (a) of the California Streets & Highways Code, a portion of the
future street area on the north side of Brundage Lane, west of '~U' Street (as shown on Parcel Map No. 6171)
in the City of Bakersfield, described in Exhibit "A" attached hereto, is excess right of way of a street not
required for street or highway purposes.
4. The action herein taken is exempt from the requirements of the California Environmental Quality
Act because there is no possibility that the action may have a significant effect on the environment.
5. Pursuant to Chapter 4 of Part 3 of Division 9 of the Streets and Highway Code, the above-
described future street area is hereby vacated and from and after the date this resolution is recorded, shah
no longer constitute a right of way for public street purposes.
6. The City Clerk shali certify to the passage of this Resolution and shall cause a certified copy
hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder
of the County of Kern, California.

A portion of Parcel 2 of Parcel Map No. 6171 per map filed in Book 26 of parcel Maps, Page 188 in the office
of the Kern County Recorder, also being a portion of the Southeast quarter of Section 31, T. 29 S., R. 28 E.,
M.D.M., City of Bakersfield, Kern County, California, more particularly described as follows:
Commencing at the Southwest corner of said Parcel 2;
THENCE North 06o2T14" East, along the west line of said Parcel 2, a distance of 25.14 feet to the true point
of beginning;
THENCE, Departing from said parcel line, North 86029'00" East, 74.80 feet to the beginning of a 2555.00 foot
radius curve, concave southerly;
TItENCE Easterly along said curve through a central angle of 00 04 54 an arc d~stance of 3.64 feet to a point
on the "Future Street Line" as dedicated per map of Tract no. 1396 filed in Book 6 of Maps, Page 56 in the
office of the Kern County Recorder;
TItENCE North 89051'00" West along said "Future Street Line", 77.72 feet to a point on the west line of said
Parcel 2;
THENCE.South 06o27'14" West, along said parcel line, 5.04 feet to the point of beginning.
Containing 196.74 sq. ft.
RESERVING THEREFROM the existing 5 foot wide public utilities easement, as dedicated per said Tract
No. 1396, which effects the west 5 feet of above described parcel.
