RESOLUTION DETERMINING THAT CERTAIN
COMMUNICATION EQUIPMENT CAN BE REASONABLY
OBTAINED FROM ONLY ONE VENDOR, ERICSSON
BUSINESS COMMUNICATIONS, INC., AND AUTHORIZING
THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING
THEREFOR, NOT TO EXCEED $75,000.00.
WHEREAS, the Ericsson telephone system has a need for a
software and hardware change. This system upgrade will enable the
City telephone system to operate under the new North American
Dialing Plan; and
WHEREAS, this software and hardware change must be
compatible with existing Ericsson proprietary telephone equipment;
and
WHEREAS, the Bell Systems' North American Dialing Plan
requires this software change so that long distance telephone calls
may be placed after January 1, 1995; and
WHEREAS, the Finance Director has determined, and has
recommended that this Council find, that the software and hardware
change can only be obtained from one vendor, Ericsson Business
Communications, Inc., because of the necessity to successfully
integrate the NorthAmerican Dialing Plan into the City's telephone
system (Ericsson system) and has recommended that this Council
authorize dispensing with bidding therefor in accordance with
Section 3.20.060 D of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
The Council hereby finds that software and hardware can
only be obtained from one vendor because of the existing
proprietary equipment and because of the necessity to successfully
integrate the NorthAmerican Dialing Plan into the City's telephone
system (Ericsson system) and authorizes the Finance Director to
dispense with bidding therefor and to negotiate the purchase of
same, not to exceed $75,000.00.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on July 20, 1994, by the following vote:
