Document Title t--- ORkGINAL RESOLUTION NO. 1[ ~' 0 ' 9 9 A RESOLUTION ORDERING THE VACATION OF A 50 FOOT PORTION OF THE ABANDONED VEHICULAR ACCESS RIGHTS ON THE WEST SIDE OF ASHE ROAD SOUTHERLY OF SCHIRRA COURT IN THE CITY OF BAKERSFIELD. WHEREAS, on WEDNESDAY, OCTOBER 6, 1999, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1207 declaring its intention to order the vacation of a 50 foot portion of the abandoned vehicular access rights on the west side of Ashe Road southerly of Schirra Court in the City of Bakersfield; and WHEREAS, all rights of vehicular ingress and egress were waived along a certain portion of the West side of Ashe Road by "Vehicular Access Dedication" filed for record in Book 5510, Page 1441, Official Records, in the Office of the Kern County Recorder; and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, November 17, 1999 after notices of said hearing were duly published and posted as required by law. WHEREAS, for the above-described project, it was determined that the proposed project is exempt from CEQA, according to Section 15305 of CEQA Guidelines, applicable to minor alterations in land use limitations (Class 5) in that the proposal consists of a minor disposition of existing public right-of-way, and WHEREAS, at its meeting on September 16, 1999, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan; and NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: Page 1 of 3 1. The above recitals are true and correct and are incorporated herein. The following portion of the West Right of Way Line of Ashe Road is unnecessary for present or prospective use for waiver of vehicular ingress and egress purposes and is hereby vacated subject to the conditions enumerated herein: That portion of the West right of way line of Ashe Road situated in the Northeast 1/4 of Section 16, T. 30 S., R. 27 E., MD.M, more particulary described as follows: Commencing at the point of intersection of the center lines of Ashe Road and Schirra Court, also being a point on the East line of the Northeast 1/4 of said Section 16; Thence S. 00° 28' 48" W, along the center line of Ashe Road, 478.91 feet; Thence N. 89° 12' 44" W., 55.00 feet to a point on the West right of way line of Ashe Road, said point being the Southeast corner of Parcel 1 of Parcel Map No. 6954 filed in Book 29 of Parcel Maps, Page 153; Thence N. 00° 28' 48" E., along said right of way line, 45.00 feet in the TRUE POINT OF BEGINNING. Thence continuing N. 00 ° 28' 48" E., along said right of way line, 50.00 feet to the point of termination. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California.
